Narrative:

I was working D5;6;26 and I was coordinating with havanna center during weather deviations. Havanna called with a hand off and I instructed the canoa/maxim controller twice; air carrier X needed to deviate east due to active military warning areas. Havanna's response was unable to deviate east and air carrier X was on about a 020 heading 15 miles south of an active warning area. Havanna authorized the pilot to continue on his heading and the pilot flew about 100 miles through active military airspace. There was coordination done with the tarpon mru to block FL370. We were then instructed by the flm to have the pilot squawk emergency due to the fact that the aircraft was in an active warning area. The tarpon controllers were helping with the situation but they do not normally give up their airspace. Recommendation; when weather gets as bad as it was in this situation there needs to be re-routes from havanna center to merida center when warning area's are active to keep the aircraft west of active military airspace. Also in this situation; tarpon mru helped out in a timely fashion which usually is not the case. When there are weather deviations; there needs to be a cap or limit on altitude of military airspace so aircraft can overfly without compromising safety.

Title: ZMA Controller described an airspace incursion when Havanna ATC was unable to issue ZMA requested turns resulting in the airspace infraction; the reporter suggesting the military's airspace be capped to allow for over flights.

Havanna called with a hand off and I instructed the CANOA/MAXIM Controller twice; Air Carrier X needed to deviate east due to active Military Warning Areas. Havanna's response was unable to deviate east and Air Carrier X was on about a 020 heading 15 miles south of an active Warning Area. Havanna authorized the pilot to continue on his heading and the pilot flew about 100 miles through active Military Airspace. There was coordination done with the TARPON MRU to block FL370. We were then instructed by the FLM to have the pilot squawk Emergency due to the fact that the aircraft was in an Active Warning area. The TARPON Controllers were helping with the situation but they do not normally give up their airspace. Recommendation; when weather gets as bad as it was in this situation there needs to be re-routes from Havanna Center to Merida Center when Warning Area's are active to keep the aircraft west of active Military Airspace.
