Narrative:

Captain sighted traffic 11 O'clock left to right (first officer flying). Captain made immediate evasive action to left, avoiding unpleasantness. Small aircraft, white/red strip probably 8500' +/- over TCA. Legal situation straining the see and avoid concept. Supplemental information from acn 87866: at approximately 8800' MSL captain called 'break left' in a calm tone. I was watching out right side of aircraft and first officer was flying and watching right also. Captain then said 'turn right now' and took control and banked left 20-25 degree of bank. The captain was the only ex-military pilot on the crew, so 'break left' had no meaning for us and he said it so calmly that he did not immediately draw our attention.

Narrative: CAPT SIGHTED TFC 11 O'CLOCK LEFT TO RIGHT (F/O FLYING). CAPT MADE IMMEDIATE EVASIVE ACTION TO LEFT, AVOIDING UNPLEASANTNESS. SMA, WHITE/RED STRIP PROBABLY 8500' +/- OVER TCA. LEGAL SITUATION STRAINING THE SEE AND AVOID CONCEPT. SUPPLEMENTAL INFO FROM ACN 87866: AT APPROX 8800' MSL CAPT CALLED 'BREAK LEFT' IN A CALM TONE. I WAS WATCHING OUT RIGHT SIDE OF ACFT AND F/O WAS FLYING AND WATCHING RIGHT ALSO. CAPT THEN SAID 'TURN RIGHT NOW' AND TOOK CONTROL AND BANKED LEFT 20-25 DEG OF BANK. THE CAPT WAS THE ONLY EX-MIL PLT ON THE CREW, SO 'BREAK LEFT' HAD NO MEANING FOR US AND HE SAID IT SO CALMLY THAT HE DID NOT IMMEDIATELY DRAW OUR ATTN.
