Narrative:

I plted flight ont-sjc. Flight plan approved by clearance at ont. Ont pom 1 gmn ave robie sns sns 347 gilro sjc. Except for minor heading changes from ATC for traffic sep prior to ave flight plan was flown. Last directional clearance after heading changes was 'cleared direct sns flight plan.' I never was given a heading to intercept the 30L ILS at sjc. Appropriate dscnts were given by ATC as aircraft was flown out the sns 347, and at gilro the aircraft was turned toward sjc VOR. I believe ATC believed we were given a heading to intercept ILS 30L as in the turn a voice suddenly cleared us the intercept, which was, of course, overshot. Upon questioning this I was told to call a phone number on arrival. I believe we were overlooked on handoff to bay approach. Supplemental information from 86357: I was off center frequency for a few mins to pick up the sjc ATIS. Upon my return we were flying the flight plan sns 347 degree right. Oak center, in my opinion, handed us off late to bay approach. I asked the captain if I could tune in the sjc 30L localizer 110.9 303 degree inbound. His reply was 'stay on sjc VOR 'cause I need the DME.' bay approach cleared us to cross muell intersection at 5000' or above and cleared for the approach 30L. We were already past the localizer. I advised bay approach that we were unable to positively identify sjc 30L localizer. Bay approach told us to turn left to 250 degrees and descend to 5000'. It was at this time when the captain gave bay approach a piece of his mind. After a few words and bickering between the captain and the controller we were assigned 270 degrees and 3000' to intercept the 30L localizer. Soon we became VMC and I reported the airport in sight. On the landline, the approach controller told the captain that he was going to do everything in his power for a violation. One small misunderstanding led to a major miscom and both the controllers and certainly the captain were out of line.

APPROPRIATE DSCNTS WERE GIVEN BY ATC AS ACFT WAS FLOWN OUT THE SNS 347, AND AT GILRO THE ACFT WAS TURNED TOWARD SJC VOR. I BELIEVE ATC BELIEVED WE WERE GIVEN A HDG TO INTERCEPT ILS 30L AS IN THE TURN A VOICE SUDDENLY CLRED US THE INTERCEPT, WHICH WAS, OF COURSE, OVERSHOT. BAY APCH CLRED US TO CROSS MUELL INTXN AT 5000' OR ABOVE AND CLRED FOR THE APCH 30L. WE WERE ALREADY PAST THE LOC. I ADVISED BAY APCH THAT WE WERE UNABLE TO POSITIVELY IDENT SJC 30L LOC. BAY APCH TOLD US TO TURN LEFT TO 250 DEGS AND DSND TO 5000'. IT WAS AT THIS TIME WHEN THE CAPT GAVE BAY APCH A PIECE OF HIS MIND. AFTER A FEW WORDS AND BICKERING BTWN THE CAPT AND THE CTLR WE WERE ASSIGNED 270 DEGS AND 3000' TO INTERCEPT THE 30L LOC. SOON WE BECAME VMC AND I RPTED THE ARPT IN SIGHT. ON THE LANDLINE, THE APCH CTLR TOLD THE CAPT THAT HE WAS GOING TO DO EVERYTHING IN HIS PWR FOR A VIOLATION. ONE SMALL MISUNDERSTANDING LED TO A MAJOR MISCOM AND BOTH THE CTLRS AND CERTAINLY THE CAPT WERE OUT OF LINE.
