Narrative:

WX: bases at 3500' MSL overcast, tops 6000' MSL, clear above. Around 120 degree radial of dqn, 35 DME, we were assigned a heading of 250 degree and clrd from 8000' to 6000'. At 6500' controller called a traffic conflict alert. Hold present altitude, traffic at 5900' climbing. 'I'm not talking to him'. The controller issued an additional warning of the traffic at 10:30 and less than 1 mi. A low wing, white, fixed gear aircraft popped out of the overcast, apparently flying in IMC without an IFR clearance. Lucky for all, the offending party was smart (?) to leave the mode C on. My many thanks to the controller.
