Narrative:

I was giving dual instruction in an small aircraft X at capital city airport. We had requested and were granted closed traffic status to runway 30 left hand pattern. The aircraft owner's wife and myself were the only two persons aboard and I was engaged in giving takeoff and landing procedures including power settings, flap and gear operations. We were on downwind for our fourth and fifth touch and go. We had called tower and received permission for the touch and go and proceeded with proper sequence. We completed a prelndg check and visibility checked a wheel down on each side. This procedure was repeated on base leg. We turned final approximately 3/4 to 1 mi from end of runway and all was well. The tower was using two runways for takeoffs at this time and an small aircraft Y was in position and holding on runway 26. This aircraft was cleared for takeoff while we were on base leg and upon turning final the takeoff clearance to the small aircraft Y was rescinded by the tower several times, however the small aircraft Y never acknowledged and continued its takeoff. At this point in time our flight conditions were 20 degree flaps, gear down and power reduced and in my opinion we were in a committed position particularly since a go around was impossible due to the position of the departing small aircraft Y. To the best of my recollection our altitude was approximately 800' MSL 3/4 mi from end of runway. The tower at this point gave us a left turn 360 degree to reenter the final. This was an evasive move. At this time the gear was retracted to reduce drag, power added to maintain altitude. We were low and slow plus turning toward a ridge. I felt this was an appropriate action due to circumstances at the time. Upon returning to short final the aircraft was being flown by the student and neither of us remembered to extend the gear. The aircraft landed gear up with minimal damage and no injuries. The FAA is handling as an incident not an accident. We received no gear warning horn during the power off landing. It is very important to note that this aircraft was flown on previous occasions including the day before and all system were working and operational. I did notice during this flight, however that the horn did not operate on one of the touch and go's when inadvertently the flaps were extended beyond 10 degree. I can't remember which pass it was, but I did make a mental note to have it checked on landing.

Title: GA SMA GEAR UP LNDG DURING TOUCH AND GO TRAINING FLT.

WE WERE ON DOWNWIND FOR OUR FOURTH AND FIFTH TOUCH AND GO. WE HAD CALLED TWR AND RECEIVED PERMISSION FOR THE TOUCH AND GO AND PROCEEDED WITH PROPER SEQUENCE. WE COMPLETED A PRELNDG CHK AND VIS CHKED A WHEEL DOWN ON EACH SIDE. THIS PROCEDURE WAS REPEATED ON BASE LEG. WE TURNED FINAL APPROX 3/4 TO 1 MI FROM END OF RWY AND ALL WAS WELL. THE TWR WAS USING TWO RWYS FOR TKOFS AT THIS TIME AND AN SMA Y WAS IN POS AND HOLDING ON RWY 26. THIS ACFT WAS CLRED FOR TKOF WHILE WE WERE ON BASE LEG AND UPON TURNING FINAL THE TKOF CLRNC TO THE SMA Y WAS RESCINDED BY THE TWR SEVERAL TIMES, HOWEVER THE SMA Y NEVER ACKNOWLEDGED AND CONTINUED ITS TKOF. AT THIS POINT IN TIME OUR FLT CONDITIONS WERE 20 DEG FLAPS, GEAR DOWN AND PWR REDUCED AND IN MY OPINION WE WERE IN A COMMITTED POS PARTICULARLY SINCE A GO AROUND WAS IMPOSSIBLE DUE TO THE POS OF THE DEPARTING SMA Y. TO THE BEST OF MY RECOLLECTION OUR ALT WAS APPROX 800' MSL 3/4 MI FROM END OF RWY. THE TWR AT THIS POINT GAVE US A LEFT TURN 360 DEG TO REENTER THE FINAL. THIS WAS AN EVASIVE MOVE. AT THIS TIME THE GEAR WAS RETRACTED TO REDUCE DRAG, PWR ADDED TO MAINTAIN ALT. WE WERE LOW AND SLOW PLUS TURNING TOWARD A RIDGE. THE ACFT LANDED GEAR UP WITH MINIMAL DAMAGE AND NO INJURIES. THE FAA IS HANDLING AS AN INCIDENT NOT AN ACCIDENT. WE RECEIVED NO GEAR WARNING HORN DURING THE PWR OFF LNDG. IT IS VERY IMPORTANT TO NOTE THAT THIS ACFT WAS FLOWN ON PREVIOUS OCCASIONS INCLUDING THE DAY BEFORE AND ALL SYS WERE WORKING AND OPERATIONAL. I DID NOTICE DURING THIS FLT, HOWEVER THAT THE HORN DID NOT OPERATE ON ONE OF THE TOUCH AND GO'S WHEN INADVERTENTLY THE FLAPS WERE EXTENDED BEYOND 10 DEG. I CAN'T REMEMBER WHICH PASS IT WAS, BUT I DID MAKE A MENTAL NOTE TO HAVE IT CHKED ON LNDG.
