Narrative:

While en route the controller called out traffic to us at 10 O'clock and 10 mi. I was the PF; and scrolled the TCAS scale down to 10 mi. I noticed traffic that was at our altitude coming towards us and told my first officer to expect an RA. The controller had said that this traffic was 1000 ft off of our altitude. We received an RA to climb; and climbed 200 ft until the RA was no longer giving us climb guidance. My first officer reported the RA to center; who then queried the other aircraft about a possible transponder problem he was having. It appears that the other aircraft had a malfunction that made his transponder report 1000 ft off of his altitude; which caused us to have an RA. It appears that this is a safety concern if he was actually 1000 ft above us and our TCAS commanded us to climb up into his flight path. For TCAS to work; everyone's equipment must be in good working order or you are receiving false information that could compromise safety.

Title: CL65 FLT CREW REPORTS TCAS RA WITH ACFT POINTED OUT BY ATC AND DESCRIBED AS 1000 FEET ABOVE OR BELOW THEIR ALTITUDE. POSSIBLE TRANSPONDER ANOMALIES ALSO REPORTED.

Narrative: WHILE ENRTE THE CTLR CALLED OUT TFC TO US AT 10 O'CLOCK AND 10 MI. I WAS THE PF; AND SCROLLED THE TCAS SCALE DOWN TO 10 MI. I NOTICED TFC THAT WAS AT OUR ALT COMING TOWARDS US AND TOLD MY FO TO EXPECT AN RA. THE CTLR HAD SAID THAT THIS TFC WAS 1000 FT OFF OF OUR ALT. WE RECEIVED AN RA TO CLB; AND CLBED 200 FT UNTIL THE RA WAS NO LONGER GIVING US CLB GUIDANCE. MY FO RPTED THE RA TO CTR; WHO THEN QUERIED THE OTHER ACFT ABOUT A POSSIBLE XPONDER PROB HE WAS HAVING. IT APPEARS THAT THE OTHER ACFT HAD A MALFUNCTION THAT MADE HIS XPONDER RPT 1000 FT OFF OF HIS ALT; WHICH CAUSED US TO HAVE AN RA. IT APPEARS THAT THIS IS A SAFETY CONCERN IF HE WAS ACTUALLY 1000 FT ABOVE US AND OUR TCAS COMMANDED US TO CLB UP INTO HIS FLT PATH. FOR TCAS TO WORK; EVERYONE'S EQUIP MUST BE IN GOOD WORKING ORDER OR YOU ARE RECEIVING FALSE INFO THAT COULD COMPROMISE SAFETY.
