Narrative:

We were climbing out on the kennedy 1 departure; breezy point climb. Climbing through about 6000 ft; the controller asked us for maximum forward speed and to not wait for 10000 ft. I thought I had misunderstood the controller; so I read back 'maximum speed' at 10000 ft. The controller corrected me and made it clear he wanted me to increase speed now. I told the controller we were unable. He asked if it was for a legal reason or an operational reason. I told him it was for legal reasons. I was then told by the controller that he was telling me to increase my speed and would take the 'heat' from doing so. I did not wish to get into a verbal exchange with the controller over the FARS. We did not comply with his request until 10000 ft.

Title: CRJ FLT CREW IS INSTRUCTED TO EXCEED FAR SPEED MAX OF 250 KTS BELOW 10000 FT; BY N90 CTLR. FLT CREW DECLINED CTLR REQUEST.

Narrative: WE WERE CLBING OUT ON THE KENNEDY 1 DEP; BREEZY POINT CLB. CLBING THROUGH ABOUT 6000 FT; THE CTLR ASKED US FOR MAX FORWARD SPD AND TO NOT WAIT FOR 10000 FT. I THOUGHT I HAD MISUNDERSTOOD THE CTLR; SO I READ BACK 'MAX SPD' AT 10000 FT. THE CTLR CORRECTED ME AND MADE IT CLR HE WANTED ME TO INCREASE SPD NOW. I TOLD THE CTLR WE WERE UNABLE. HE ASKED IF IT WAS FOR A LEGAL REASON OR AN OPERATIONAL REASON. I TOLD HIM IT WAS FOR LEGAL REASONS. I WAS THEN TOLD BY THE CTLR THAT HE WAS TELLING ME TO INCREASE MY SPD AND WOULD TAKE THE 'HEAT' FROM DOING SO. I DID NOT WISH TO GET INTO A VERBAL EXCHANGE WITH THE CTLR OVER THE FARS. WE DID NOT COMPLY WITH HIS REQUEST UNTIL 10000 FT.
