Narrative:

Lga ground control cleared me to taxi to runway 13 via txwys G; B; F; hold short of runway 22. When I turned onto taxiway F I noticed the hold short line was painted halfway between taxiway B and runway 22. I know this is to keep large aircraft from putting their right wing over runway 22. As I approached the hold short line I determined that if I stopped right there; I would leave my tail on taxiway B; but I still had a lot of room ahead of me without encroaching on runway 22. I slowed below normal taxi speed and crossed the hold short line. The first officer queried me; 'we are going to hold short of runway 22 right?' I said; 'yes; but I want my tail clear.' the first officer visually checked runway 22 and monitored our spacing. I rolled 4 or 5 ft beyond the hold short line and stopped. No part of my aircraft touched runway 22. As I stopped; an aircraft landing on runway 22 passed taxiway F and ground cleared me to continue taxiing across runway 22; txwys east; cc; hold short of taxiway G. All communications with ground were routine. They did not express any concern about my actions; or ask me to contact them. 5 hours later I was asked to contact lga tower. They notified me that; 'they cleared me to cross runway 22 because they thought I was going to do that anyway; so we're going to file against you.' they would not say that I actually encroached onto runway 22 prior to receiving clearance to cross. When I explained that I thought I could both hold short of runway 22; and not block taxiway B; they said; 'we don't need your help.'

Title: MD80 FLT CREW REPORTS ROLLING 5 FT PAST THE HOLD LINE FOR RWY 22 ON FOXTROT AT LGA AFTER BEING INSTRUCTED TO HOLD SHORT; TO CLEAR THE BRAVO TXWY. THE FLT CREW IS NOTIFIED LATER THAT LGA TOWER INTENDS TO FILE A VIOLATION AGAINST THEM.

I SLOWED BELOW NORMAL TAXI SPD AND CROSSED THE HOLD SHORT LINE. THE FO QUERIED ME; 'WE ARE GOING TO HOLD SHORT OF RWY 22 RIGHT?' I SAID; 'YES; BUT I WANT MY TAIL CLR.' THE FO VISUALLY CHKED RWY 22 AND MONITORED OUR SPACING. I ROLLED 4 OR 5 FT BEYOND THE HOLD SHORT LINE AND STOPPED. NO PART OF MY ACFT TOUCHED RWY 22. AS I STOPPED; AN ACFT LNDG ON RWY 22 PASSED TXWY F AND GND CLRED ME TO CONTINUE TAXIING ACROSS RWY 22; TXWYS E; CC; HOLD SHORT OF TXWY G. ALL COMS WITH GND WERE ROUTINE. THEY DID NOT EXPRESS ANY CONCERN ABOUT MY ACTIONS; OR ASK ME TO CONTACT THEM. 5 HRS LATER I WAS ASKED TO CONTACT LGA TWR. THEY NOTIFIED ME THAT; 'THEY CLRED ME TO CROSS RWY 22 BECAUSE THEY THOUGHT I WAS GOING TO DO THAT ANYWAY; SO WE'RE GOING TO FILE AGAINST YOU.' THEY WOULD NOT SAY THAT I ACTUALLY ENCROACHED ONTO RWY 22 PRIOR TO RECEIVING CLRNC TO CROSS. WHEN I EXPLAINED THAT I THOUGHT I COULD BOTH HOLD SHORT OF RWY 22; AND NOT BLOCK TXWY B; THEY SAID; 'WE DON'T NEED YOUR HELP.'
