Narrative:

During pushback air carrier Y C402 taxied under our wing while taxiing out and came within 20 ft with propellers spinning of our guide man. We complained to ATC; they said they did not clear him. I inquired how he got the clearance to taxi; no response was given. I called the tower supervisor and complained; the supervisor said it was a non movement area; this has not always been the case in the alley in bos. If it's a non movement area; how do aircraft taxi in and out? This would suggest a movement area. This is my third report on this problem; air carrier Y comes in and out of the alley with no clearance and speaks to no one. They will kill someone soon if this procedure continues and or damage an aircraft or serious injury. This has got to stop. What does it take to get the FAA to regain control of this area or start to fine for reckless operation in the alley?

Narrative: DURING PUSHBACK ACR Y C402 TAXIED UNDER OUR WING WHILE TAXIING OUT AND CAME WITHIN 20 FT WITH PROPS SPINNING OF OUR GUIDE MAN. WE COMPLAINED TO ATC; THEY SAID THEY DID NOT CLR HIM. I CALLED THE TWR SUPVR AND COMPLAINED; THE SUPVR SAID IT WAS A NON MOVEMENT AREA; THIS HAS NOT ALWAYS BEEN THE CASE IN THE ALLEY IN BOS. IF IT'S A NON MOVEMENT AREA; HOW DO ACFT TAXI IN AND OUT? THIS WOULD SUGGEST A MOVEMENT AREA. THIS IS MY THIRD RPT ON THIS PROB; ACR Y COMES IN AND OUT OF THE ALLEY WITH NO CLRNC AND SPEAKS TO NO ONE. THEY WILL KILL SOMEONE SOON IF THIS PROC CONTINUES AND OR DAMAGE AN ACFT OR SERIOUS INJURY. THIS HAS GOT TO STOP. WHAT DOES IT TAKE TO GET THE FAA TO REGAIN CTL OF THIS AREA OR START TO FINE FOR RECKLESS OPERATION IN THE ALLEY?
