Narrative:

Because of previous experience with the coney climb out of lga; when issued the departure with clearance delivery; I contacted clearance and told them 'we could not guarantee that we will be able to make the climb restr of the coney climb' as required by the chart for the laguardia nine departure. At takeoff at 44652 pounds (maximum of 44801 pounds); we departed using a static takeoff procedure to do our best to make the coney climb restr of crossing at or above 1500 ft at 2.5 DME from lga VOR; even though we had previously worked it out to not require the crossing restr with ATC. We were unable to make the crossing restr; passing 2.5 DME at around 1440 ft MSL. The aircraft did not accept climb power the first time the button was pressed; so we ended up having an extra 5-10 seconds at altitude-takeoff power longer than normal.

Title: EMB145 FLT CREW IS UNABLE TO MEET XING RESTR ON THE LGA 9 DEP.

Narrative: BECAUSE OF PREVIOUS EXPERIENCE WITH THE CONEY CLB OUT OF LGA; WHEN ISSUED THE DEP WITH CLRNC DELIVERY; I CONTACTED CLRNC AND TOLD THEM 'WE COULD NOT GUARANTEE THAT WE WILL BE ABLE TO MAKE THE CLB RESTR OF THE CONEY CLB' AS REQUIRED BY THE CHART FOR THE LAGUARDIA NINE DEP. AT TKOF AT 44652 LBS (MAX OF 44801 LBS); WE DEPARTED USING A STATIC TKOF PROC TO DO OUR BEST TO MAKE THE CONEY CLB RESTR OF XING AT OR ABOVE 1500 FT AT 2.5 DME FROM LGA VOR; EVEN THOUGH WE HAD PREVIOUSLY WORKED IT OUT TO NOT REQUIRE THE XING RESTR WITH ATC. WE WERE UNABLE TO MAKE THE XING RESTR; PASSING 2.5 DME AT AROUND 1440 FT MSL. THE ACFT DID NOT ACCEPT CLB PWR THE FIRST TIME THE BUTTON WAS PRESSED; SO WE ENDED UP HAVING AN EXTRA 5-10 SECONDS AT ALT-TKOF PWR LONGER THAN NORMAL.
