Narrative:

We were recalled by dispatch approximately 1 hour into our flight for WX forecast. During our return we discussed overweight landing procedures; coordination holding at intersection/10000 ft with center; and configured to maximum drag in order to burn down to maximum landing weight. We reviewed flight manual and informed dispatch of our intentions. After several mins; we received an ACARS message assuring us that an overweight landing was perfectly legal in this instance. To my recollection; ACARS paragraph 2 was cited as authority/authorized to land overweight with the captain's emergency authority/authorized. We then declared an emergency and landed; wrote up the incident in the log and flew the same aircraft the following day. The captain retained referenced ACARS message.

Title: A B757-200 FLT CREW RETURNED TO DEP ARPT BECAUSE OF DEST WX AND CHOSE TO USE EMER AUTH TO LAND OVERWT.

Narrative: WE WERE RECALLED BY DISPATCH APPROX 1 HR INTO OUR FLT FOR WX FORECAST. WE REVIEWED FLT MANUAL AND INFORMED DISPATCH OF OUR INTENTIONS. AFTER SEVERAL MINS; WE RECEIVED AN ACARS MESSAGE ASSURING US THAT AN OVERWT LNDG WAS PERFECTLY LEGAL IN THIS INSTANCE. TO MY RECOLLECTION; ACARS PARAGRAPH 2 WAS CITED AS AUTH TO LAND OVERWT WITH THE CAPT'S EMER AUTH. WE THEN DECLARED AN EMER AND LANDED; WROTE UP THE INCIDENT IN THE LOG AND FLEW THE SAME ACFT THE FOLLOWING DAY. THE CAPT RETAINED REFERENCED ACARS MESSAGE.
