Narrative:

While on the nobly 2 departure out of dfw and prior to the turn at the cuzen intersection; we received a TA alert. I had the autoplt engaged and noted that we were on centerline for the departure. Then; I noted the bearing and altitude for the alerted traffic at 11 O'clock position and 1500 ft above. I looked through my eyebrow window to see a cpr type learjet with winglets pass overhead on a northwesterly heading. I was alarmed because we had no ATC warning about the traffic or a lower leveloff altitude assigned other than the 10000 ft on the departure; as one would expect; if there were an ATC awareness of such crossing traffic. The departure frequency was very busy and we had not been able to check in with the departure controller prior to this event due to the volume of transmission by other aircraft to the departure controller. I am concerned about the potential for a midair with this type of scenario on the RNAV departure. In the past; I have had instructions to level at 6000 ft for such a similar situation on this particular departure.

Title: MD80 DEPARTING DFW RECEIVES TCAS TA ON XING TFC 1500 FT ABOVE.

Narrative: WHILE ON THE NOBLY 2 DEP OUT OF DFW AND PRIOR TO THE TURN AT THE CUZEN INTXN; WE RECEIVED A TA ALERT. I HAD THE AUTOPLT ENGAGED AND NOTED THAT WE WERE ON CTRLINE FOR THE DEP. THEN; I NOTED THE BEARING AND ALT FOR THE ALERTED TFC AT 11 O'CLOCK POS AND 1500 FT ABOVE. I LOOKED THROUGH MY EYEBROW WINDOW TO SEE A CPR TYPE LEARJET WITH WINGLETS PASS OVERHEAD ON A NORTHWESTERLY HDG. I WAS ALARMED BECAUSE WE HAD NO ATC WARNING ABOUT THE TFC OR A LOWER LEVELOFF ALT ASSIGNED OTHER THAN THE 10000 FT ON THE DEP; AS ONE WOULD EXPECT; IF THERE WERE AN ATC AWARENESS OF SUCH XING TFC. THE DEP FREQ WAS VERY BUSY AND WE HAD NOT BEEN ABLE TO CHK IN WITH THE DEP CTLR PRIOR TO THIS EVENT DUE TO THE VOLUME OF XMISSION BY OTHER ACFT TO THE DEP CTLR. I AM CONCERNED ABOUT THE POTENTIAL FOR A MIDAIR WITH THIS TYPE OF SCENARIO ON THE RNAV DEP. IN THE PAST; I HAVE HAD INSTRUCTIONS TO LEVEL AT 6000 FT FOR SUCH A SIMILAR SITUATION ON THIS PARTICULAR DEP.
