Narrative:

Multiple times pulling in to gate; while waiting to start APU at brake set; fuel truck (lavatory truck) personnel became present on right side of airplane either in front of or near vicinity of engine #2. Engine #2 was still running while I started APU. This is an unsafe operating practice! Then; I have APU started when marshallers were spotted and aircraft was in the vicinity of the gate. I adhered to the 45 min rule. I would suggest changing wording in poh to allow APU start at the time and conditions stated above.
