Narrative:

The flight was cleared for an ILS approach to runway 12 at iad. The ILS GS was OTS, the VASI was OTS, and the approach lights were OTS. The captain informed ATC that he was unable to accept the ILS approach clearance. Another controller came on, and in a hostile tone and with obvious anger, cleared the flight to a fix. The captain said he had the airport in sight and he requested a visual approach, which was granted. Prior to this, 2 other pilots informed the first controller that the ILS was not usable, but this information did not seem to mean anything to the controller, who continued to issue the ILS approach clearance. The flight required a legal clearance for the approach, and the ILS was not a legal clearance with the GS OTS. The captain's concern is with the obvious hostile tone of the controller, and because neither of them seemed to understand that the ILS approach was not an appropriate clearance because the GS was OTS.

Title: CL65 FLT CREW EXPRESSED CONCERN REGARDING ILS RWY 12 APCH ISSUED BY ATC WITH SEVERAL NAVAID COMPONENTS OTS.

Narrative: THE FLT WAS CLRED FOR AN ILS APCH TO RWY 12 AT IAD. THE ILS GS WAS OTS, THE VASI WAS OTS, AND THE APCH LIGHTS WERE OTS. THE CAPT INFORMED ATC THAT HE WAS UNABLE TO ACCEPT THE ILS APCH CLRNC. ANOTHER CTLR CAME ON, AND IN A HOSTILE TONE AND WITH OBVIOUS ANGER, CLRED THE FLT TO A FIX. THE CAPT SAID HE HAD THE ARPT IN SIGHT AND HE REQUESTED A VISUAL APCH, WHICH WAS GRANTED. PRIOR TO THIS, 2 OTHER PLTS INFORMED THE FIRST CTLR THAT THE ILS WAS NOT USABLE, BUT THIS INFO DID NOT SEEM TO MEAN ANYTHING TO THE CTLR, WHO CONTINUED TO ISSUE THE ILS APCH CLRNC. THE FLT REQUIRED A LEGAL CLRNC FOR THE APCH, AND THE ILS WAS NOT A LEGAL CLRNC WITH THE GS OTS. THE CAPT'S CONCERN IS WITH THE OBVIOUS HOSTILE TONE OF THE CTLR, AND BECAUSE NEITHER OF THEM SEEMED TO UNDERSTAND THAT THE ILS APCH WAS NOT AN APPROPRIATE CLRNC BECAUSE THE GS WAS OTS.
