Narrative:

On A300 from jfk to sju, just past huber, we tried to request 30 NM east deviation of course due to thunderstorms along the route. ATC told us there was an emergency on frequency and to go to backup (3 times). We tried all backup frequencys, ie, 11330, 5550, 8846 and finally got to request this on 6586. I declared captain's authority/authorized and explained the problems with ATC, plus the moderate chop and thunderstorms on the route via phone patch with ZNY. They approved with no other problems noted.

I DECLARED CAPT'S AUTH AND EXPLAINED THE PROBS WITH ATC, PLUS THE MODERATE CHOP AND TSTMS ON THE RTE VIA PHONE PATCH WITH ZNY. THEY APPROVED WITH NO OTHER PROBS NOTED.
