Narrative:

Using duats, I received a standard weather briefing and filed an IFR flight plan from atlantic city municipal (kaiy) to a northern new jersey airport. Upon arrival at kaiy, I completed a preflight inspection, noting no anomalies. I contacted the published clearance delivery frequency using a handheld radio and obtained my IFR clearance. I do not recall routing, but my clearance began with the bader three departure and included robbinsville VOR (rbv) as an en route fix. The wind was generally out of the east, favoring a runway 11 departure. I taxied to and held short of the departure end of runway 11. After completing the 'before takeoff' checklist, I contacted clearance delivery and advised that I was ready to depart runway 11. Clearance delivery indicated that I was released for departure and issued a void time. I taxied onto the runway and executed a normal takeoff. Once airborne, I executed a left turn to a heading of 040 degrees as soon as practicable, following the bader three departure, and continued to climb. As I rolled out on a heading of 040 degrees, I noticed that the airplane was heading directly at the borgata hotel and casino, a 480 ft high rise building completed in 2003. I deviation left to a heading of approximately 030 degrees to pass west of the building. After passing, I returned to the heading of 040 degrees required by the bader three departure. Had I not deviation, I would have passed directly over the borgata at a perilously low altitude, perhaps 500 ft or less above it's roof. I did not advise atlantic city departure of the 10 degree westward turn nor did they question the deviation. Soon after passing the borgata and returning to the published heading of 040 degrees, I was cleared direct to robbinsville VOR (rbv). The remainder of the flight proceeded without incident. The borgata is a new high-rise hotel and casino, which began construction in 2000 and opened in 2003. Unlike most other atlantic city casinos, it is not located on the boardwalk running along the southeastern shore of atlantic city. Instead, the borgata is located approximately one mile northwest of the boardwalk. Prior to construction of the borgata, a turn of a heading of 040 degrees after a runway 11 departure may have been sufficient to avoid the high-rise buildings along the boardwalk. However, because the borgata is located substantially northwest of other high-rise buildings, this turn is no longer sufficient. To prevent future recurrences of this issue, I recommend the bader three departure be amended to require a left turn to at least 020 degrees for runway 11 departures.

I DO NOT RECALL ROUTING, BUT MY CLRNC BEGAN WITH THE BADER THREE DEP AND INCLUDED ROBBINSVILLE VOR (RBV) AS AN ENRTE FIX. THE WIND WAS GENERALLY OUT OF THE EAST, FAVORING A RWY 11 DEP. I TAXIED TO AND HELD SHORT OF THE DEP END OF RWY 11. AFTER COMPLETING THE 'BEFORE TKOF' CHECKLIST, I CONTACTED CLRNC DELIVERY AND ADVISED THAT I WAS READY TO DEPART RWY 11. CLRNC DELIVERY INDICATED THAT I WAS RELEASED FOR DEP AND ISSUED A VOID TIME. I TAXIED ONTO THE RWY AND EXECUTED A NORMAL TKOF. ONCE AIRBORNE, I EXECUTED A L TURN TO A HDG OF 040 DEGS AS SOON AS PRACTICABLE, FOLLOWING THE BADER THREE DEP, AND CONTINUED TO CLB. AS I ROLLED OUT ON A HDG OF 040 DEGS, I NOTICED THAT THE AIRPLANE WAS HEADING DIRECTLY AT THE BORGATA HOTEL AND CASINO, A 480 FT HIGH RISE BUILDING COMPLETED IN 2003. I DEV L TO A HDG OF APPROX 030 DEGS TO PASS WEST OF THE BUILDING. AFTER PASSING, I RETURNED TO THE HDG OF 040 DEGS REQUIRED BY THE BADER THREE DEP. HAD I NOT DEV, I WOULD HAVE PASSED DIRECTLY OVER THE BORGATA AT A PERILOUSLY LOW ALT, PERHAPS 500 FT OR LESS ABOVE IT'S ROOF. HOWEVER, BECAUSE THE BORGATA IS LOCATED SUBSTANTIALLY NORTHWEST OF OTHER HIGH-RISE BUILDINGS, THIS TURN IS NO LONGER SUFFICIENT. TO PREVENT FUTURE RECURRENCES OF THIS ISSUE, I RECOMMEND THE BADER THREE DEP BE AMENDED TO REQUIRE A L TURN TO AT LEAST 020 DEGS FOR RWY 11 DEPS.
