Narrative:

Apparent confusion between ewr ATC and another flight resulted in an RA requiring our aircraft to climb from assigned 3000 ft MSL to 3700 ft MSL. A TCASII traffic warning was followed in about 5 seconds by monitor vertical speed followed by climb command. As we climbed, the aircraft below us also was climbing and in my opinion did not follow his TCASII advisory. The conflicting aircraft with the red square box had a climbing arrow and 600 ft below us. We climbed to 3700 ft before the conflict was clear. ATC never warned us of the aircraft and seemed annoyed that we were not in position to land at ewr airport. The controller advised us to descend to make the approach. We reached 3000 ft MSL on the extended centerline of runway 22L, and were asked to sidestep to runway 22R and complied, landed without further incident.

Title: FLT CREW OF B737, ON ARR TO EWR, RESPOND APPROPRIATELY TO TCASII RA.

Narrative: APPARENT CONFUSION BTWN EWR ATC AND ANOTHER FLT RESULTED IN AN RA REQUIRING OUR ACFT TO CLB FROM ASSIGNED 3000 FT MSL TO 3700 FT MSL. A TCASII TFC WARNING WAS FOLLOWED IN ABOUT 5 SECONDS BY MONITOR VERT SPD FOLLOWED BY CLB COMMAND. AS WE CLBED, THE ACFT BELOW US ALSO WAS CLBING AND IN MY OPINION DID NOT FOLLOW HIS TCASII ADVISORY. THE CONFLICTING ACFT WITH THE RED SQUARE BOX HAD A CLBING ARROW AND 600 FT BELOW US. WE CLBED TO 3700 FT BEFORE THE CONFLICT WAS CLR. ATC NEVER WARNED US OF THE ACFT AND SEEMED ANNOYED THAT WE WERE NOT IN POS TO LAND AT EWR ARPT. THE CTLR ADVISED US TO DSND TO MAKE THE APCH. WE REACHED 3000 FT MSL ON THE EXTENDED CTRLINE OF RWY 22L, AND WERE ASKED TO SIDESTEP TO RWY 22R AND COMPLIED, LANDED WITHOUT FURTHER INCIDENT.
