Narrative:

When reviewing the aircraft's logbook during the preflight stage of an MD11 international passenger flight, the #1 FMC was deferred by company maintenance control on a subsequent flight. When referring to the aircraft's MEL, it was noted that the #1 FMC couldn't be deferred if the aircraft was equipped with 'GPWS envelope modulation features.' since the aircraft's #1 FMC was previously deferred and signed by maintenance control it was assumed that this particular equipment was not installed on the aircraft. It was also assumed that the previous crew had verified this with company maintenance personnel prior to their flight. It was later found that maintenance control was in error and that this aircraft was equipped with this feature and subsequently flown illegally.

Title: AN MD11 WAS DISPATCHED IN NON COMPLIANCE WITH THE #1 FMC DEFERRED AS INOP IN CONFLICT WITH THE MEL.

Narrative: WHEN REVIEWING THE ACFT'S LOGBOOK DURING THE PREFLT STAGE OF AN MD11 INTL PAX FLT, THE #1 FMC WAS DEFERRED BY COMPANY MAINT CTL ON A SUBSEQUENT FLT. WHEN REFERRING TO THE ACFT'S MEL, IT WAS NOTED THAT THE #1 FMC COULDN'T BE DEFERRED IF THE ACFT WAS EQUIPPED WITH 'GPWS ENVELOPE MODULATION FEATURES.' SINCE THE ACFT'S #1 FMC WAS PREVIOUSLY DEFERRED AND SIGNED BY MAINT CTL IT WAS ASSUMED THAT THIS PARTICULAR EQUIP WAS NOT INSTALLED ON THE ACFT. IT WAS ALSO ASSUMED THAT THE PREVIOUS CREW HAD VERIFIED THIS WITH COMPANY MAINT PERSONNEL PRIOR TO THEIR FLT. IT WAS LATER FOUND THAT MAINT CTL WAS IN ERROR AND THAT THIS ACFT WAS EQUIPPED WITH THIS FEATURE AND SUBSEQUENTLY FLOWN ILLEGALLY.
