Narrative:

While on departure control after takeoff from las vegas, we were cleared to maintain 8000 ft. Traffic passed overhead at 10000 ft. We were heading approximately 250 degrees toward high terrain. Over idale intersection, MSA is 10000 ft. I believe ATC forgot we were restr to 8000 ft as he was talking to another aircraft. I was about to take evasive action as the terrain was visible to us and we were getting too close for comfort. Aircraft was egpws equipped and this added an additional level of comfort. ATC finally turned us 20 degrees left. A subsequent climb was given. We continued uneventfully to destination.

Title: B757-200 CREW WAS CONCERNED THE LAS DEP CTLR FORGOT ABOUT THEM WHEN THEY WERE FLYING TOWARDS HIGH TERRAIN, AND THE ACFT HAD AN 8000 FT ALT CLRNC.

Narrative: WHILE ON DEP CTL AFTER TKOF FROM LAS VEGAS, WE WERE CLRED TO MAINTAIN 8000 FT. TFC PASSED OVERHEAD AT 10000 FT. WE WERE HDG APPROX 250 DEGS TOWARD HIGH TERRAIN. OVER IDALE INTXN, MSA IS 10000 FT. I BELIEVE ATC FORGOT WE WERE RESTR TO 8000 FT AS HE WAS TALKING TO ANOTHER ACFT. I WAS ABOUT TO TAKE EVASIVE ACTION AS THE TERRAIN WAS VISIBLE TO US AND WE WERE GETTING TOO CLOSE FOR COMFORT. ACFT WAS EGPWS EQUIPPED AND THIS ADDED AN ADDITIONAL LEVEL OF COMFORT. ATC FINALLY TURNED US 20 DEGS L. A SUBSEQUENT CLB WAS GIVEN. WE CONTINUED UNEVENTFULLY TO DEST.
