Narrative:

We departed on runway 24 and were given the SID (teterboro 5). Upon climbing to 1500 ft, I turned to a heading of 280 degrees. I initiated to start the climb to 2000 ft. I looked at the DME on the first officer side and it showed more than 4.5 DME. The first officer had tuned 108.7 into the radio instead of the proper 108.4. The incorrect frequency was the DME from newark, not teterboro. The controller questioned our early climb, he did not indicate a conflict. No TCASII warning was triggered. No other anomalies observed.

Title: AN LR45 FLT CREW BUSTS THEIR ALT XING RESTR WITH AN EARLY CLB DURING THE TEB 5 DEP PROC OUT OF TEB, NJ.

Narrative: WE DEPARTED ON RWY 24 AND WERE GIVEN THE SID (TETERBORO 5). UPON CLBING TO 1500 FT, I TURNED TO A HDG OF 280 DEGS. I INITIATED TO START THE CLB TO 2000 FT. I LOOKED AT THE DME ON THE FO SIDE AND IT SHOWED MORE THAN 4.5 DME. THE FO HAD TUNED 108.7 INTO THE RADIO INSTEAD OF THE PROPER 108.4. THE INCORRECT FREQ WAS THE DME FROM NEWARK, NOT TETERBORO. THE CTLR QUESTIONED OUR EARLY CLB, HE DID NOT INDICATE A CONFLICT. NO TCASII WARNING WAS TRIGGERED. NO OTHER ANOMALIES OBSERVED.
