Narrative:

I departed dxr IFR with flight clearance direct to cmk radar vectors to jfk, V16 to dixie intersection direct acy direct aiy. I encountered IMC climbing and descending en route. Upon my return trip, I departed in clear VFR conditions as the previous WX forecast was for clearing trends VFR all day. I did not get an updated WX forecast as the WX was clear and improving conditions were forecast. I departed aiy and flew along the new jersey shore northbound heading to dxr. At approximately 37 DME, I contacted new york on frequency 127.40 and asked for permission to enter class B airspace to fly over jfk direct to dxr, as I have done for the past 20 yrs. I fly this route approximately 3 times per month and am very familiar with the routing. I was given a transponder code and was asked by the controller if I had filed a VFR flight plan. My response was negative. I was then told by the controller to fly a heading of 305 degrees. A second controller came on and advised me that I was approaching controled airspace, and I was instructed to a heading of 320 degrees and was advised that I should remain 30 mi from jfk, ewr, and lga. I dialed into my GPS ewr and 31.9 DME was the distance from ewr. I maintained 32-34 DME distance southwest and west of ewr and remained well outside the 30 mi ring as depicted on the new york VFR sectional map all the way to dxr. Unless there was an error on the reporting capabilities of my GPS at the time, all indications were consistent: I was beyond the 30 NM range of ewr, jfk, and lga. Also, I was in radio contact with new york controllers who gave me headings throughout this ordeal. Therefore, I thought I was well outside the restr area. This statement is made to the best of my recollection of the incident.

Title: BE36 PLT TRANSITIONING NEW YORK AREA IS CONCERNED ABOUT PENETRATING RESTR AIRSPACE.

Narrative: I DEPARTED DXR IFR WITH FLT CLRNC DIRECT TO CMK RADAR VECTORS TO JFK, V16 TO DIXIE INTXN DIRECT ACY DIRECT AIY. I ENCOUNTERED IMC CLBING AND DSNDING ENRTE. UPON MY RETURN TRIP, I DEPARTED IN CLR VFR CONDITIONS AS THE PREVIOUS WX FORECAST WAS FOR CLRING TRENDS VFR ALL DAY. I DID NOT GET AN UPDATED WX FORECAST AS THE WX WAS CLR AND IMPROVING CONDITIONS WERE FORECAST. I DEPARTED AIY AND FLEW ALONG THE NEW JERSEY SHORE NBOUND HDG TO DXR. AT APPROX 37 DME, I CONTACTED NEW YORK ON FREQ 127.40 AND ASKED FOR PERMISSION TO ENTER CLASS B AIRSPACE TO FLY OVER JFK DIRECT TO DXR, AS I HAVE DONE FOR THE PAST 20 YRS. I FLY THIS RTE APPROX 3 TIMES PER MONTH AND AM VERY FAMILIAR WITH THE ROUTING. I WAS GIVEN A XPONDER CODE AND WAS ASKED BY THE CTLR IF I HAD FILED A VFR FLT PLAN. MY RESPONSE WAS NEGATIVE. I WAS THEN TOLD BY THE CTLR TO FLY A HDG OF 305 DEGS. A SECOND CTLR CAME ON AND ADVISED ME THAT I WAS APCHING CTLED AIRSPACE, AND I WAS INSTRUCTED TO A HDG OF 320 DEGS AND WAS ADVISED THAT I SHOULD REMAIN 30 MI FROM JFK, EWR, AND LGA. I DIALED INTO MY GPS EWR AND 31.9 DME WAS THE DISTANCE FROM EWR. I MAINTAINED 32-34 DME DISTANCE SW AND W OF EWR AND REMAINED WELL OUTSIDE THE 30 MI RING AS DEPICTED ON THE NEW YORK VFR SECTIONAL MAP ALL THE WAY TO DXR. UNLESS THERE WAS AN ERROR ON THE RPTING CAPABILITIES OF MY GPS AT THE TIME, ALL INDICATIONS WERE CONSISTENT: I WAS BEYOND THE 30 NM RANGE OF EWR, JFK, AND LGA. ALSO, I WAS IN RADIO CONTACT WITH NEW YORK CTLRS WHO GAVE ME HDGS THROUGHOUT THIS ORDEAL. THEREFORE, I THOUGHT I WAS WELL OUTSIDE THE RESTR AREA. THIS STATEMENT IS MADE TO THE BEST OF MY RECOLLECTION OF THE INCIDENT.
