Narrative:

On taxi out at den, en route to runway 8, first officer told me that load planning needs to relocate passenger for weight and balance. I instructed first officer to call purser and tell him to relocate passenger. Flight attendant asked first officer if we would stop to move passenger. I told first officer that we would continue to taxi slowly toward runway 8. Passenger were moved and we prepared for takeoff. Flight attendant expressed concern to first officer about moving people while taxiing. We made a normal takeoff. Upon reaching altitude, I called and told him it was a mistake to continue taxi while people were being moved. I made this decision based on fom guidance which states that if passenger get up on taxi out it is my decision whether to stop or continue taxi. Unfortunately, in this situation, I should have stopped and moved the people. I told flight attendant this and that my decision was incorrect for the situation. Flight was conducted normally. After all passenger deplaned, an FAA person showed me his credentials and asked for my license which was presented. He told me a letter would be forthcoming concerning moving passenger while taxiing. He was traveling as a passenger in an unofficial status. Supplemental information from acn 570406: we were taxiing out of dia for our leg to ict and were advised to call load planning. They told us that we needed to move some people out of the back 2 rows. We didn't come to a stop as we were taxiing in line on left to runway 8. The FAA was on board and wrote us up on landing in ict.

Title: A B737-300 CREW MOVED PAX WITHOUT STOPPING THE ACFT COMPLETELY. AN FAA REPRESENTATIVE THREATENED REPRIMAND.

Narrative: ON TAXI OUT AT DEN, ENRTE TO RWY 8, FO TOLD ME THAT LOAD PLANNING NEEDS TO RELOCATE PAX FOR WT AND BAL. I INSTRUCTED FO TO CALL PURSER AND TELL HIM TO RELOCATE PAX. FLT ATTENDANT ASKED FO IF WE WOULD STOP TO MOVE PAX. I TOLD FO THAT WE WOULD CONTINUE TO TAXI SLOWLY TOWARD RWY 8. PAX WERE MOVED AND WE PREPARED FOR TKOF. FLT ATTENDANT EXPRESSED CONCERN TO FO ABOUT MOVING PEOPLE WHILE TAXIING. WE MADE A NORMAL TKOF. UPON REACHING ALT, I CALLED AND TOLD HIM IT WAS A MISTAKE TO CONTINUE TAXI WHILE PEOPLE WERE BEING MOVED. AFTER ALL PAX DEPLANED, AN FAA PERSON SHOWED ME HIS CREDENTIALS AND ASKED FOR MY LICENSE WHICH WAS PRESENTED. HE TOLD ME A LETTER WOULD BE FORTHCOMING CONCERNING MOVING PAX WHILE TAXIING. HE WAS TRAVELING AS A PAX IN AN UNOFFICIAL STATUS. SUPPLEMENTAL INFO FROM ACN 570406: WE WERE TAXIING OUT OF DIA FOR OUR LEG TO ICT AND WERE ADVISED TO CALL LOAD PLANNING. THEY TOLD US THAT WE NEEDED TO MOVE SOME PEOPLE OUT OF THE BACK 2 ROWS. WE DIDN'T COME TO A STOP AS WE WERE TAXIING IN LINE ON L TO RWY 8. THE FAA WAS ON BOARD AND WROTE US UP ON LNDG IN ICT.
