Agent asked us if we could transport empty oxygen bottles. Consulted flight manual and said yes. Ramper assured us the 2 bottles were empty and asked where to place them. Consulted flight manual, no specific location given, so I approved the flight attendant compartment after the ramper said that is where they usually put them. Agent gave us a hazmat form for crew for each bottle. Any weight given assumed to be that of bottle. Flight completed, bottles unloaded. Subsequently informed bottles not empty.

Title: AN EMBRAER 145 WAS DISPATCHED IN NON COMPLIANCE WITH 2 SVCABLE OXYGEN CANISTERS LOADED IN THE AFT CARGO COMPARTMENT. CREW WAS ADVISED CANISTERS WERE EMPTY.

Narrative: AGENT ASKED US IF WE COULD TRANSPORT EMPTY OXYGEN BOTTLES. CONSULTED FLT MANUAL AND SAID YES. RAMPER ASSURED US THE 2 BOTTLES WERE EMPTY AND ASKED WHERE TO PLACE THEM. CONSULTED FLT MANUAL, NO SPECIFIC LOCATION GIVEN, SO I APPROVED THE FLT ATTENDANT COMPARTMENT AFTER THE RAMPER SAID THAT IS WHERE THEY USUALLY PUT THEM. AGENT GAVE US A HAZMAT FORM FOR CREW FOR EACH BOTTLE. ANY WT GIVEN ASSUMED TO BE THAT OF BOTTLE. FLT COMPLETED, BOTTLES UNLOADED. SUBSEQUENTLY INFORMED BOTTLES NOT EMPTY.
