Narrative:

Received a pointout on aircraft Y from ZID at FL390. Aircraft X was climbing off ord and issued FL410. When aircraft X was asked if he could be level before in conflict with aircraft Y. He answered in the affirmative. When aircraft X was asked what his rate of climb was out of FL390, he responded that he could not make the altitude in time. Aircraft X was issued a 110 degree heading but we were not able to hold 5 mi separation.

Title: ZAU CTLR WAS UNABLE TO PREVENT A LOSS OF SEPARATION BTWN A B757 CLBING TO FL410 AND AN ACR LEVEL AT FL390.

Narrative: RECEIVED A POINTOUT ON ACFT Y FROM ZID AT FL390. ACFT X WAS CLBING OFF ORD AND ISSUED FL410. WHEN ACFT X WAS ASKED IF HE COULD BE LEVEL BEFORE IN CONFLICT WITH ACFT Y. HE ANSWERED IN THE AFFIRMATIVE. WHEN ACFT X WAS ASKED WHAT HIS RATE OF CLB WAS OUT OF FL390, HE RESPONDED THAT HE COULD NOT MAKE THE ALT IN TIME. ACFT X WAS ISSUED A 110 DEG HDG BUT WE WERE NOT ABLE TO HOLD 5 MI SEPARATION.
