Narrative:

We received clearance to climb from FL270 to FL330 from ZME. At approximately FL273, we had a TA for an aircraft approximately 700 ft above us (FL280). We spotted the aircraft (an MD80) in conflict and leveled (approximately FL274). Shortly after leveling, we had an RA and began to descend to avoid the conflict. When we were clear of the traffic, we continued our climb to FL330. ATC was notified of the RA. TCASII definitely helped avoid a midair collision. It enabled us to quickly locate the traffic and take corrective action. I believe the problem arose by ATC inadvertently giving us a clearance to climb with conflicting traffic.

Title: E145 FLC INITIATES EVASIVE MANEUVER WHEN IN CLB TO FL330 TO AVOID AN MD80 AT FL280 UNDER ZME CTL.

Narrative: WE RECEIVED CLRNC TO CLB FROM FL270 TO FL330 FROM ZME. AT APPROX FL273, WE HAD A TA FOR AN ACFT APPROX 700 FT ABOVE US (FL280). WE SPOTTED THE ACFT (AN MD80) IN CONFLICT AND LEVELED (APPROX FL274). SHORTLY AFTER LEVELING, WE HAD AN RA AND BEGAN TO DSND TO AVOID THE CONFLICT. WHEN WE WERE CLR OF THE TFC, WE CONTINUED OUR CLB TO FL330. ATC WAS NOTIFIED OF THE RA. TCASII DEFINITELY HELPED AVOID A MIDAIR COLLISION. IT ENABLED US TO QUICKLY LOCATE THE TFC AND TAKE CORRECTIVE ACTION. I BELIEVE THE PROB AROSE BY ATC INADVERTENTLY GIVING US A CLRNC TO CLB WITH CONFLICTING TFC.
