Narrative:

ATC reroutes of flights without regard to potential legality issues. Zza-zzb flight which is operated by a 737-800 which currently doesn't have ETOPS certification is being rerouted or attempted to be rerouted nightly by ny oceanic into ETOPS airspace even though another route had been coordinated between the company and ZNY. It appears that a few controllers are arbitrarily doing this. The easiest solution would be to get the aircraft ETOPS certified for that area, but that won't happen in the near term. ATC management needs to make controllers more aware of possible route restrictions which may not be immediately obvious on their scopes.

Title: B-737-800 CREW WAS GIVEN AN ATC REROUTE THAT WAS ILLEGAL BECAUSE THE ACFT WAS NOT APPROVED FOR ETOPS OP.

Narrative: ATC REROUTES OF FLIGHTS WITHOUT REGARD TO POTENTIAL LEGALITY ISSUES. ZZA-ZZB FLT WHICH IS OPERATED BY A 737-800 WHICH CURRENTLY DOESN'T HAVE ETOPS CERTIFICATION IS BEING REROUTED OR ATTEMPTED TO BE REROUTED NIGHTLY BY NY OCEANIC INTO ETOPS AIRSPACE EVEN THOUGH ANOTHER ROUTE HAD BEEN COORDINATED BTWN THE COMPANY AND ZNY. IT APPEARS THAT A FEW CTLRS ARE ARBITRARILY DOING THIS. THE EASIEST SOLUTION WOULD BE TO GET THE ACFT ETOPS CERTIFIED FOR THAT AREA, BUT THAT WON'T HAPPEN IN THE NEAR TERM. ATC MGMNT NEEDS TO MAKE CTLRS MORE AWARE OF POSSIBLE RTE RESTRICTIONS WHICH MAY NOT BE IMMEDIATELY OBVIOUS ON THEIR SCOPES.
