Narrative:

The FAA was intending to issue a letter of investigation for what they represented was an altitude deviation which had occurred on nov/xa/00. It is alleged that they had cleared flight Z of which I was the first officer on a flight from bna to jax, to FL280, and that the altitude was exceeded without further clearance. I remember our having been asked to descend to FL280, which we did. My recollection is that we were cleared to a higher altitude, and that we were issued an amended clearance after having passed FL280. We took no particular note of the occurrence at the time. Had we thought there was an altitude deviation at the time, we would have discussed the mater and filed reports. We both thought the flight was routine. Further note: I recall having to reset the MCP to cruise at the requested altitude.

Title: ACR CREW NOTIFIED THAT THEY WERE BEING INVESTIGATED FOR ALT OVERSHOOT. CLRNC IS AT ISSUE.

Narrative: THE FAA WAS INTENDING TO ISSUE A LETTER OF INVESTIGATION FOR WHAT THEY REPRESENTED WAS AN ALTDEV WHICH HAD OCCURRED ON NOV/XA/00. IT IS ALLEGED THAT THEY HAD CLRED FLT Z OF WHICH I WAS THE FO ON A FLT FROM BNA TO JAX, TO FL280, AND THAT THE ALT WAS EXCEEDED WITHOUT FURTHER CLRNC. I REMEMBER OUR HAVING BEEN ASKED TO DSND TO FL280, WHICH WE DID. MY RECOLLECTION IS THAT WE WERE CLRED TO A HIGHER ALT, AND THAT WE WERE ISSUED AN AMENDED CLRNC AFTER HAVING PASSED FL280. WE TOOK NO PARTICULAR NOTE OF THE OCCURRENCE AT THE TIME. HAD WE THOUGHT THERE WAS AN ALTDEV AT THE TIME, WE WOULD HAVE DISCUSSED THE MATER AND FILED RPTS. WE BOTH THOUGHT THE FLT WAS ROUTINE. FURTHER NOTE: I RECALL HAVING TO RESET THE MCP TO CRUISE AT THE REQUESTED ALT.
