Narrative:

As we were climbing out of 11000 ft with center, we noticed air carrier Y converging with us. We were climbing to 12000 ft, and slowed our rate of climb. Advised ATC and they stated air carrier Y should be climbing. Presently 800 ft above, we stopped our climb at 11500 ft and advised ATC. Simultaneously we then received a 3000 ft climb from TCASII. I determined that to follow the RA would put the aircraft in greater danger. During our leveloff we also noted that air carrier Y had initiated a descent, for a few seconds and then immediately began a climb. Our RA was very late and unsure if it may have sent a descent to air carrier Y with us receiving a climb. Our climb of 3000 FPM would have most definitely provided a midair. We turned aggressively behind the aircraft and immediately back to our vector. No further action required. One final note, we received a TA about 15 seconds after we had a visual with the aircraft and about 20 seconds prior to the RA.

Title: FLC OF AN EMB145 LEVELED OFF DURING CLBOUT IN RESPONSE TO A TCASII RA AND SUBSEQUENTLY MADE AN EVASIVE ACTION TURN BEHIND A SUPER S80 AFTER OBSERVING IT CLBING NEAR THEIR FLT PATH.

Narrative: AS WE WERE CLBING OUT OF 11000 FT WITH CTR, WE NOTICED ACR Y CONVERGING WITH US. WE WERE CLBING TO 12000 FT, AND SLOWED OUR RATE OF CLB. ADVISED ATC AND THEY STATED ACR Y SHOULD BE CLBING. PRESENTLY 800 FT ABOVE, WE STOPPED OUR CLB AT 11500 FT AND ADVISED ATC. SIMULTANEOUSLY WE THEN RECEIVED A 3000 FT CLB FROM TCASII. I DETERMINED THAT TO FOLLOW THE RA WOULD PUT THE ACFT IN GREATER DANGER. DURING OUR LEVELOFF WE ALSO NOTED THAT ACR Y HAD INITIATED A DSCNT, FOR A FEW SECONDS AND THEN IMMEDIATELY BEGAN A CLB. OUR RA WAS VERY LATE AND UNSURE IF IT MAY HAVE SENT A DSCNT TO ACR Y WITH US RECEIVING A CLB. OUR CLB OF 3000 FPM WOULD HAVE MOST DEFINITELY PROVIDED A MIDAIR. WE TURNED AGGRESSIVELY BEHIND THE ACFT AND IMMEDIATELY BACK TO OUR VECTOR. NO FURTHER ACTION REQUIRED. ONE FINAL NOTE, WE RECEIVED A TA ABOUT 15 SECONDS AFTER WE HAD A VISUAL WITH THE ACFT AND ABOUT 20 SECONDS PRIOR TO THE RA.
