Narrative:

Words cannot express my anger and outrage for the continual rerte of air carrier XXX on an almost continual basis. This fix balancing problem needs to be corrected now and in a collaborative basis. These unannounced rertes are wrong, illegal and unsafe. ATC has no right to change my route unless a greater emergency exists. Traffic separation is their responsibility, not traffic rerouting. I have worked closely with ZAB tmu management to try to resolve this issue, but the abuse of my flight continues despite all of our efforts. My regulations require me to flight plan a flight considering winds aloft, driftdown, WX en route and other factors relating to the safety of my flight. If ATC changes my route, all of that planning is a moot point and no longer can the safe planning of my flight be assured. If the controllers are going to determine the route of my aircraft, they need to consider all of the same factors I do. Until those factors are considered, then any change -- outside of an emergency -- is an unsafe and illegal action. Callback conversation with reporter revealed the following information: there have been up to 50 reports filed by this reporter. He alleges that the rerte is done for fix balancing in the arrival area of phoenix and that it is usually done very shortly after takeoff from memphis. It is a more southerly route adding as much as 13-17 mins to flight time. This much flight time on a recurrent basis is a substantial economic issue with his management. The reporter estimates that the flight in question is rerted from 40-50% of the time. Another air carrier he is familiar with serving phoenix estimates they are rerted off the nrp flight plans up to 80% of the time. The reporter suggests that parallel routing along J6 of west coast traffic and phx traffic may be a possibility to alleviate longer reroutings that are presently used.

Title: AN ACR DISPATCHER COMPLAINS THAT HIS WORK IN DEVELOPING A RTE AND FILING IT ON THE NRP IS FOR NOTHING BECAUSE ZAB ARTCC CONTINUES TO CHANGE THE ROUTING AFTER DEP.

Narrative: WORDS CANNOT EXPRESS MY ANGER AND OUTRAGE FOR THE CONTINUAL RERTE OF ACR XXX ON AN ALMOST CONTINUAL BASIS. THIS FIX BALANCING PROB NEEDS TO BE CORRECTED NOW AND IN A COLLABORATIVE BASIS. THESE UNANNOUNCED RERTES ARE WRONG, ILLEGAL AND UNSAFE. ATC HAS NO RIGHT TO CHANGE MY RTE UNLESS A GREATER EMER EXISTS. TFC SEPARATION IS THEIR RESPONSIBILITY, NOT TFC REROUTING. I HAVE WORKED CLOSELY WITH ZAB TMU MGMNT TO TRY TO RESOLVE THIS ISSUE, BUT THE ABUSE OF MY FLT CONTINUES DESPITE ALL OF OUR EFFORTS. IF ATC CHANGES MY RTE, ALL OF THAT PLANNING IS A MOOT POINT AND NO LONGER CAN THE SAFE PLANNING OF MY FLT BE ASSURED. IF THE CTLRS ARE GOING TO DETERMINE THE RTE OF MY ACFT, THEY NEED TO CONSIDER ALL OF THE SAME FACTORS I DO. UNTIL THOSE FACTORS ARE CONSIDERED, THEN ANY CHANGE -- OUTSIDE OF AN EMER -- IS AN UNSAFE AND ILLEGAL ACTION. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THERE HAVE BEEN UP TO 50 RPTS FILED BY THIS RPTR. HE ALLEGES THAT THE RERTE IS DONE FOR FIX BALANCING IN THE ARR AREA OF PHOENIX AND THAT IT IS USUALLY DONE VERY SHORTLY AFTER TKOF FROM MEMPHIS. IT IS A MORE SOUTHERLY RTE ADDING AS MUCH AS 13-17 MINS TO FLT TIME. THIS MUCH FLT TIME ON A RECURRENT BASIS IS A SUBSTANTIAL ECONOMIC ISSUE WITH HIS MGMNT. THE RPTR ESTIMATES THAT THE FLT IN QUESTION IS RERTED FROM 40-50% OF THE TIME. ANOTHER ACR HE IS FAMILIAR WITH SERVING PHOENIX ESTIMATES THEY ARE RERTED OFF THE NRP FLT PLANS UP TO 80% OF THE TIME.
