Narrative:

As I complete the pre takeoff checklist at the hold line at nyo runway 28, a high wing exp. Tailwheel aircraft landed. I then heard a third aircraft (cherokee) call base to land runway 28. Expecting plenty of time before cherokee turned final, I immediately called 'taking runway 28 for immediate departure'. Cherokee acknowledged, as I was already moving. Well past the hold line, but still not turned onto the runway, I saw the cherokee on a close-in base (closer than I expected, but still ok). I continued onto the runway, at which time I observed the landing experimental still on the runway at the far end. I added power, as I watched for experimental to clear the runway, with plenty of runway to abort if needed. Concerned about the landing cherokee, I added full power. Cherokee called advising 'traffic on runway'. I acknowledged, saying I'll stay well clear. Cherokee announced go around seeing the experimental begin to turn, I decided to continue the takeoff. Experimental may not have cleared the runway as I lifted off mid-field and passed overhead at aprrox 300 ft AGL. Continued normal departure. Factors: busy flying, desire not to delay others or force a go around by others. Actions: should have waited for the cherokee to land, preventing the whole chain of events. Could also have stopped on the runway, forcing the cherokee to go around. Could also have aborted takeoff and exited at mid-field taxiway. Callback conversation with reporter revealed the following information: reporter stated an ultra light fly-in had just ended and the field was starting to get very busy. He said he did not make a clearing turn before taking the runway.

Narrative: AS I COMPLETE THE PRE TKOF CHECKLIST AT THE HOLD LINE AT NYO RWY 28, A HIGH WING EXP. TAILWHEEL ACFT LANDED. I THEN HEARD A THIRD ACFT (CHEROKEE) CALL BASE TO LAND RWY 28. EXPECTING PLENTY OF TIME BEFORE CHEROKEE TURNED FINAL, I IMMEDIATELY CALLED 'TAKING RWY 28 FOR IMMEDIATE DEP'. CHEROKEE ACKNOWLEDGED, AS I WAS ALREADY MOVING. WELL PAST THE HOLD LINE, BUT STILL NOT TURNED ONTO THE RWY, I SAW THE CHEROKEE ON A CLOSE-IN BASE (CLOSER THAN I EXPECTED, BUT STILL OK). I CONTINUED ONTO THE RWY, AT WHICH TIME I OBSERVED THE LNDG EXPERIMENTAL STILL ON THE RWY AT THE FAR END. I ADDED POWER, AS I WATCHED FOR EXPERIMENTAL TO CLR THE RWY, WITH PLENTY OF RWY TO ABORT IF NEEDED. CONCERNED ABOUT THE LNDG CHEROKEE, I ADDED FULL POWER. CHEROKEE CALLED ADVISING 'TFC ON RWY'. I ACKNOWLEDGED, SAYING I'LL STAY WELL CLR. CHEROKEE ANNOUNCED GAR SEEING THE EXPERIMENTAL BEGIN TO TURN, I DECIDED TO CONTINUE THE TKOF. EXPERIMENTAL MAY NOT HAVE CLRED THE RWY AS I LIFTED OFF MID-FIELD AND PASSED OVERHEAD AT APRROX 300 FT AGL. CONTINUED NORMAL DEP. FACTORS: BUSY FLYING, DESIRE NOT TO DELAY OTHERS OR FORCE A GAR BY OTHERS. ACTIONS: SHOULD HAVE WAITED FOR THE CHEROKEE TO LAND, PREVENTING THE WHOLE CHAIN OF EVENTS. COULD ALSO HAVE STOPPED ON THE RWY, FORCING THE CHEROKEE TO GAR. COULD ALSO HAVE ABORTED TKOF AND EXITED AT MID-FIELD TXWY. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATED AN ULTRA LIGHT FLY-IN HAD JUST ENDED AND THE FIELD WAS STARTING TO GET VERY BUSY. HE SAID HE DID NOT MAKE A CLRING TURN BEFORE TAKING THE RWY.
