Narrative:

Climbing out of lax, we were switched to a second socal departure frequency, I believe 132.32 or 132.45. Controller told us we were #1 over seal beach VOR. He said increase speed to 300 KTS as soon as possible. I repeated out of 10000 ft we will increase to 300 KTS, but we may have a problem then with the 14000 ft restr over sli. Controller said we were beyond the 3 mi limit and to increase now. He also said something else about keeping us out over the water and don't worry about the restr. We did not feel comfortable with this clearance, as I did not think ATC could assign a speed greater than 250 KTS below 10000 ft.

Title: FLC OF A B757 QUESTIONED THE LEGALITY OF DEP CTL REQUEST TO INCREASE AIRSPD ABOVE 250 KTS BELOW 10000 FT MSL DURING A DEP CLB FROM LAX.

Narrative: CLBING OUT OF LAX, WE WERE SWITCHED TO A SECOND SOCAL DEP FREQ, I BELIEVE 132.32 OR 132.45. CTLR TOLD US WE WERE #1 OVER SEAL BEACH VOR. HE SAID INCREASE SPD TO 300 KTS ASAP. I REPEATED OUT OF 10000 FT WE WILL INCREASE TO 300 KTS, BUT WE MAY HAVE A PROB THEN WITH THE 14000 FT RESTR OVER SLI. CTLR SAID WE WERE BEYOND THE 3 MI LIMIT AND TO INCREASE NOW. HE ALSO SAID SOMETHING ELSE ABOUT KEEPING US OUT OVER THE WATER AND DON'T WORRY ABOUT THE RESTR. WE DID NOT FEEL COMFORTABLE WITH THIS CLRNC, AS I DID NOT THINK ATC COULD ASSIGN A SPD GREATER THAN 250 KTS BELOW 10000 FT.
