Narrative:

Initial clearance from san jose was for the loupe 9. 2 previous flts had been cleared via runway heading and first officer asked for this option. We were given this clearance by ground during taxi out. At takeoff first officer reconfirmed runway heading with tower. After departure, bay asked us to level at 3500 ft and turn right 170 degrees. Generally continued on the loupe 9. I don't believe there was a conflict but the controller did ask us about our clearance. He said they apparently had had a communication problem. We had confirmed clearance twice and felt we had done as asked.
