Narrative:

We were climbing to 15000 ft as assigned by ATC. The other aircraft was level at 15000 ft. We were never advised of the aircraft by ATC. We received TCASII alert -- no RA. If we had been climbing faster, we would have had a near miss. Evasive action would have been required. Nothing was ever said by ATC about the traffic conflict. There was no error on our assigned altitude (on our part). ATC should have assigned us 14000 ft.

Title: CL65 AND E145 HAD LESS THAN LEGAL SEPARATION IN ZAU CLASS E AIRSPACE. BOTH ACFT WERE ON IFR FLT PLANS.

Narrative: WE WERE CLBING TO 15000 FT AS ASSIGNED BY ATC. THE OTHER ACFT WAS LEVEL AT 15000 FT. WE WERE NEVER ADVISED OF THE ACFT BY ATC. WE RECEIVED TCASII ALERT -- NO RA. IF WE HAD BEEN CLBING FASTER, WE WOULD HAVE HAD A NEAR MISS. EVASIVE ACTION WOULD HAVE BEEN REQUIRED. NOTHING WAS EVER SAID BY ATC ABOUT THE TFC CONFLICT. THERE WAS NO ERROR ON OUR ASSIGNED ALT (ON OUR PART). ATC SHOULD HAVE ASSIGNED US 14000 FT.
