Narrative:

On idle wilde climb, kennedy 7 departure, cleared to 3000 ft and handed off to departure. On 135.9 heard ATC advise VFR aircraft we were through his altitude. Checked on at 3000 ft, ATC queried altitude. Next controller reported us through 8000 ft as we were climbing through 7000 ft. Controller after that reported our mode C intermittent. Switched to #2 transponder, no further problems.
