Narrative:

Tower cleared flight abc to turn left to intercept outbound course and climb to FL280. We are aware of NOTAM on new noise abatement procedure -- not yet in commercial charts -- but assumed tower clearance overrode the noise abatement procedure. After takeoff, tower queried us about the noise abatement procedure and we advised him that we thought his clearance overrode them. He responded no, but that there was no problem. Lesson learned -- ask if clearance negates the published procedure.
