Narrative:

On aug/xa/99, I was the PIC of flight which made a night landing on runway 12L at msp at approximately XA30. First officer was at the controls for landing. After touchdown, I heard tower clear another aircraft to 'position and hold' and indicate to him traffic was on a 2-3 mi final (not their exact words). During the rollout, we were instructed to turn off and contact ground on 121.8. No mention of any other traffic was made. I took control of the aircraft at approximately 60 KTS and determined I could safely make a taxiway E4 turnoff. I noticed an A320 (later determined to be on taxiway east between taxiway E2 and taxiway E3.) I fully expected the A320 to give way to me as I exited the active runway. After I was established on the taxiway E4 turnoff (still with all landing/taxi lights on), the A320 was now passing taxiway E3 and it became apparent he was not stopping or for that matter giving any indication of slowing. I had to make an uncomfortable, aggressive stop, short of clearing the active runway, to avoid a possible collision. As he passed, I estimate we had approximately 15-20 ft clearance between his right wingtip and my nose dome. Myself, my first officer and jump seater were all shocked the A320 had not stopped. I am sure that the 50+ passenger on the right side of his aircraft were also quite alarmed, staring into the lights of another airplane so close to them. There were 202 passenger and crew on my aircraft. The A320 had 130 passenger, plus crew. Fortunately, there were no flight attendants or passenger out of their seats on my aircraft, so no injuries resulted. I shudder to think what might have happened if my brakes had failed. In my mind there is not doubt there would have been a collision. I felt I had the right-of-way in this situation as I needed to '...exit the runway without delay at the first available taxiway...(and)...taxi clear of the landing runway even if that requires the aircraft to protrude into or cross another taxiway, runway or ramp after clearing the landing runway' (aim 4-69). I'm confident that I, myself, and I believe any other pilot would have stopped, if for no other reason than out of courtesy. However, after looking into the far/aim regulations, I can find no requirements for taxiing aircraft to give way to traffic exiting an active runway (unless of course they are instructed to do so by ATC).

Title: CAPT OF A B757 MADE AN ABRUPT STOP AFTER TURNING OFF THE RWY FROM LNDG DUE TO AN AIRBUS A320 TAXIING ON THE TXWY TO WHICH THE RPTR WAS HDG.

Narrative: ON AUG/XA/99, I WAS THE PIC OF FLT WHICH MADE A NIGHT LNDG ON RWY 12L AT MSP AT APPROX XA30. FO WAS AT THE CTLS FOR LNDG. AFTER TOUCHDOWN, I HEARD TWR CLR ANOTHER ACFT TO 'POS AND HOLD' AND INDICATE TO HIM TFC WAS ON A 2-3 MI FINAL (NOT THEIR EXACT WORDS). DURING THE ROLLOUT, WE WERE INSTRUCTED TO TURN OFF AND CONTACT GND ON 121.8. NO MENTION OF ANY OTHER TFC WAS MADE. I TOOK CTL OF THE ACFT AT APPROX 60 KTS AND DETERMINED I COULD SAFELY MAKE A TXWY E4 TURNOFF. I NOTICED AN A320 (LATER DETERMINED TO BE ON TXWY E BTWN TXWY E2 AND TXWY E3.) I FULLY EXPECTED THE A320 TO GIVE WAY TO ME AS I EXITED THE ACTIVE RWY. AFTER I WAS ESTABLISHED ON THE TXWY E4 TURNOFF (STILL WITH ALL LNDG/TAXI LIGHTS ON), THE A320 WAS NOW PASSING TXWY E3 AND IT BECAME APPARENT HE WAS NOT STOPPING OR FOR THAT MATTER GIVING ANY INDICATION OF SLOWING. I HAD TO MAKE AN UNCOMFORTABLE, AGGRESSIVE STOP, SHORT OF CLRING THE ACTIVE RWY, TO AVOID A POSSIBLE COLLISION. AS HE PASSED, I ESTIMATE WE HAD APPROX 15-20 FT CLRNC BTWN HIS R WINGTIP AND MY NOSE DOME. MYSELF, MY FO AND JUMP SEATER WERE ALL SHOCKED THE A320 HAD NOT STOPPED. I AM SURE THAT THE 50+ PAX ON THE R SIDE OF HIS ACFT WERE ALSO QUITE ALARMED, STARING INTO THE LIGHTS OF ANOTHER AIRPLANE SO CLOSE TO THEM. THERE WERE 202 PAX AND CREW ON MY ACFT. THE A320 HAD 130 PAX, PLUS CREW. FORTUNATELY, THERE WERE NO FLT ATTENDANTS OR PAX OUT OF THEIR SEATS ON MY ACFT, SO NO INJURIES RESULTED. I SHUDDER TO THINK WHAT MIGHT HAVE HAPPENED IF MY BRAKES HAD FAILED. IN MY MIND THERE IS NOT DOUBT THERE WOULD HAVE BEEN A COLLISION. I FELT I HAD THE RIGHT-OF-WAY IN THIS SIT AS I NEEDED TO '...EXIT THE RWY WITHOUT DELAY AT THE FIRST AVAILABLE TXWY...(AND)...TAXI CLR OF THE LNDG RWY EVEN IF THAT REQUIRES THE ACFT TO PROTRUDE INTO OR CROSS ANOTHER TXWY, RWY OR RAMP AFTER CLRING THE LNDG RWY' (AIM 4-69). I'M CONFIDENT THAT I, MYSELF, AND I BELIEVE ANY OTHER PLT WOULD HAVE STOPPED, IF FOR NO OTHER REASON THAN OUT OF COURTESY. HOWEVER, AFTER LOOKING INTO THE FAR/AIM REGS, I CAN FIND NO REQUIREMENTS FOR TAXIING ACFT TO GIVE WAY TO TFC EXITING AN ACTIVE RWY (UNLESS OF COURSE THEY ARE INSTRUCTED TO DO SO BY ATC).
