Narrative:

Along with takeoff clearance tower advised us to not add 100% power until past men and equipment west of runway. Advised dispatch and they advised performance engineering who when appraised that the distance was approximately 2000 ft until clear of the construction area said there was no way to engineer for the situation. Dispatch had conversation with sea tower who said they would continue to issue clearance and dispatcher said all further flight plans would include a note not to accept said clearance. Sea needs to define the work area and officially close that portion of the runway so affected, or stop the clearance game as to comply with clearance might have aircraft departing outside the normal takeoff performance/engineering envelope and incur violations and attendant liability.

Title: A BOEING B767 FLC WAS ASKED TO DELAY FULL APPLICATION UNTIL PAST THE CONSTRUCTION AREA NEAR THE RWY AT SEA.

Narrative: ALONG WITH TKOF CLRNC TWR ADVISED US TO NOT ADD 100% PWR UNTIL PAST MEN AND EQUIP W OF RWY. ADVISED DISPATCH AND THEY ADVISED PERFORMANCE ENGINEERING WHO WHEN APPRAISED THAT THE DISTANCE WAS APPROX 2000 FT UNTIL CLR OF THE CONSTRUCTION AREA SAID THERE WAS NO WAY TO ENGINEER FOR THE SIT. DISPATCH HAD CONVERSATION WITH SEA TWR WHO SAID THEY WOULD CONTINUE TO ISSUE CLRNC AND DISPATCHER SAID ALL FURTHER FLT PLANS WOULD INCLUDE A NOTE NOT TO ACCEPT SAID CLRNC. SEA NEEDS TO DEFINE THE WORK AREA AND OFFICIALLY CLOSE THAT PORTION OF THE RWY SO AFFECTED, OR STOP THE CLRNC GAME AS TO COMPLY WITH CLRNC MIGHT HAVE ACFT DEPARTING OUTSIDE THE NORMAL TKOF PERFORMANCE/ENGINEERING ENVELOPE AND INCUR VIOLATIONS AND ATTENDANT LIABILITY.
