Narrative:

On departure from yul during normal climb out, flew through speed 235-240 KTS during normal departure and clean-up profile to achieve aircraft clean minimum maneuvering airspeed. The first officer properly pointed out that the company page showed 200 KT restr below 3000 ft AGL, but I said we need not comply because our minimum safe speed was higher. I later, referring to flight manual in both domestic and international sections, saw no relief from published speed restrs in canada based upon minimum safe operational speeds -- unlike united states far which allows speed exceedance when required by aircraft normal operations. Please advise if canadian regulations parallel united states regulations in this regard, or did I, in fact, bust an operational restr. The first officer, again, quite properly expressed his concern to me and I take responsibility for overriding his concerns.

Title: MD80 CREW HAD QUESTIONS ABOUT SPD CTL IN CANADIAN AIRSPACE.

Narrative: ON DEP FROM YUL DURING NORMAL CLBOUT, FLEW THROUGH SPD 235-240 KTS DURING NORMAL DEP AND CLEAN-UP PROFILE TO ACHIEVE ACFT CLEAN MINIMUM MANEUVERING AIRSPD. THE FO PROPERLY POINTED OUT THAT THE COMPANY PAGE SHOWED 200 KT RESTR BELOW 3000 FT AGL, BUT I SAID WE NEED NOT COMPLY BECAUSE OUR MINIMUM SAFE SPD WAS HIGHER. I LATER, REFERRING TO FLT MANUAL IN BOTH DOMESTIC AND INTL SECTIONS, SAW NO RELIEF FROM PUBLISHED SPD RESTRS IN CANADA BASED UPON MINIMUM SAFE OPERATIONAL SPDS -- UNLIKE UNITED STATES FAR WHICH ALLOWS SPD EXCEEDANCE WHEN REQUIRED BY ACFT NORMAL OPS. PLEASE ADVISE IF CANADIAN REGS PARALLEL UNITED STATES REGS IN THIS REGARD, OR DID I, IN FACT, BUST AN OPERATIONAL RESTR. THE FO, AGAIN, QUITE PROPERLY EXPRESSED HIS CONCERN TO ME AND I TAKE RESPONSIBILITY FOR OVERRIDING HIS CONCERNS.
