Narrative:

We were assigned the runway 33 departure of the cyyz 3 SID. This calls for a dogleg after takeoff with no unauthorized turns per the noise abatement procedure until reaching 3600 ft and maltn intersection. After takeoff and into the first left turn, ATC assigned us a southwest heading (I think 220 degrees). We took this as authority/authorized to continue the turn. ATC came back stating that we had turned early in violation of their noise abatement procedure. I said that I misunderstood his instruction, only hearing the vector. He said we needed to follow the procedure (a right turn then left) prior to taking the vector. Neither the first officer nor I remember him stating instructions to comply with noise abatement prior to taking the vector. I believe we just miscommunicated during a high workload time in the departure. Supplemental information from acn 434344: at 11000 ft MSL, I started the left turn to heading 320 degrees to intercept the yyz 343 degree radial. While in the turn, departure control told us to turn to heading 240 degrees. I continued the turn to 240 degrees. At about 3000 ft MSL, departure control told us we should have delayed our turn until passing 3600 ft per the SID. I don't recall them mentioning for us to comply with any noise abatement procedures when giving us the turn to 240 degrees. If they did, I would have understood that to mean -- comply with the canadian vmap-a noise abatement climb profile, which we did. If they want us to delay a directed turn, they should say 'after passing 3600 ft' or 'after maltn intersection, turn to XXX degrees.

Title: AN A300-600 FREIGHTER DEPARTING RWY 33 AT YYZ TURNS EARLY OFF THE NOISE ABATEMENT PROC, AT THE CTLR'S REQUEST. CTLR QUESTIONS THEIR TURN AS BEING IN VIOLATION WITH THE PUBLISHED PROC.

Narrative: WE WERE ASSIGNED THE RWY 33 DEP OF THE CYYZ 3 SID. THIS CALLS FOR A DOGLEG AFTER TKOF WITH NO UNAUTH TURNS PER THE NOISE ABATEMENT PROC UNTIL REACHING 3600 FT AND MALTN INTXN. AFTER TKOF AND INTO THE FIRST L TURN, ATC ASSIGNED US A SW HDG (I THINK 220 DEGS). WE TOOK THIS AS AUTH TO CONTINUE THE TURN. ATC CAME BACK STATING THAT WE HAD TURNED EARLY IN VIOLATION OF THEIR NOISE ABATEMENT PROC. I SAID THAT I MISUNDERSTOOD HIS INSTRUCTION, ONLY HEARING THE VECTOR. HE SAID WE NEEDED TO FOLLOW THE PROC (A R TURN THEN L) PRIOR TO TAKING THE VECTOR. NEITHER THE FO NOR I REMEMBER HIM STATING INSTRUCTIONS TO COMPLY WITH NOISE ABATEMENT PRIOR TO TAKING THE VECTOR. I BELIEVE WE JUST MISCOMMUNICATED DURING A HIGH WORKLOAD TIME IN THE DEP. SUPPLEMENTAL INFO FROM ACN 434344: AT 11000 FT MSL, I STARTED THE L TURN TO HDG 320 DEGS TO INTERCEPT THE YYZ 343 DEG RADIAL. WHILE IN THE TURN, DEP CTL TOLD US TO TURN TO HDG 240 DEGS. I CONTINUED THE TURN TO 240 DEGS. AT ABOUT 3000 FT MSL, DEP CTL TOLD US WE SHOULD HAVE DELAYED OUR TURN UNTIL PASSING 3600 FT PER THE SID. I DON'T RECALL THEM MENTIONING FOR US TO COMPLY WITH ANY NOISE ABATEMENT PROCS WHEN GIVING US THE TURN TO 240 DEGS. IF THEY DID, I WOULD HAVE UNDERSTOOD THAT TO MEAN -- COMPLY WITH THE CANADIAN VMAP-A NOISE ABATEMENT CLB PROFILE, WHICH WE DID. IF THEY WANT US TO DELAY A DIRECTED TURN, THEY SHOULD SAY 'AFTER PASSING 3600 FT' OR 'AFTER MALTN INTXN, TURN TO XXX DEGS.
