Narrative:

Dornier (aircraft X) departed wbound, had a trim problem, and decided to return to airport. Boeing (aircraft Y) departed behind, also wbound. Dornier was idented and turned to airport, and subsequently given 3000 ft. As paths crossed, boeing asked if traffic was 700 ft below and climbing. I replied it was a dornier restr to 3000 ft. Dornier indicated he was trying to get to 3000 ft but was having trouble due to trim. Nothing else was said by boeing about the incident.

Title: APCH CTLR DOES NOT APPLY POSITIVE SEPARATION BTWN 2 DEPARTING ACFT, ONE RETURNING DUE TO TRIM PROBS AND THE OTHER OUTCLBING THE RETURNING ACFT.

Narrative: DORNIER (ACFT X) DEPARTED WBOUND, HAD A TRIM PROB, AND DECIDED TO RETURN TO ARPT. BOEING (ACFT Y) DEPARTED BEHIND, ALSO WBOUND. DORNIER WAS IDENTED AND TURNED TO ARPT, AND SUBSEQUENTLY GIVEN 3000 FT. AS PATHS CROSSED, BOEING ASKED IF TFC WAS 700 FT BELOW AND CLBING. I REPLIED IT WAS A DORNIER RESTR TO 3000 FT. DORNIER INDICATED HE WAS TRYING TO GET TO 3000 FT BUT WAS HAVING TROUBLE DUE TO TRIM. NOTHING ELSE WAS SAID BY BOEING ABOUT THE INCIDENT.
