Narrative:

On dec/xa/98 after departure from hsv to dfw, we were faced with a medical emergency diversion to remove a passenger at jan. After receiving a flight plan and a departure plan from air carrier dispatch, we made an attempt to get a departure plan. Due to the lack of personnel and facilities (jan is an affiliate's station and we were parked at another air carrier's gate on the far end of the terminal from the affiliate's operations office), the first officer and I made the decision to depart without the departure plan. Upon review of operating manuals and discussions with air carrier safety departments, I now understand that information from the departure plan involving security and other concerns is required for every flight. I understand that my decision was in violation of far and flight manual requirements. I should not have let the need to get the remaining passenger to their destination override the need to comply with regulations. I did not realize the violation until I talked to air carrier safety today. I regret that this report is required and that it is submitted at this late date.

Title: AN ACR FK10 DEPARTED FROM AN ARPT AFTER A DIVERSION WITHOUT OBTAINING A LOAD AND DEP PLAN FROM THEIR DISPATCHER IN VIOLATION OF FAR.

Narrative: ON DEC/XA/98 AFTER DEP FROM HSV TO DFW, WE WERE FACED WITH A MEDICAL EMER DIVERSION TO REMOVE A PAX AT JAN. AFTER RECEIVING A FLT PLAN AND A DEP PLAN FROM ACR DISPATCH, WE MADE AN ATTEMPT TO GET A DEP PLAN. DUE TO THE LACK OF PERSONNEL AND FACILITIES (JAN IS AN AFFILIATE'S STATION AND WE WERE PARKED AT ANOTHER ACR'S GATE ON THE FAR END OF THE TERMINAL FROM THE AFFILIATE'S OPS OFFICE), THE FO AND I MADE THE DECISION TO DEPART WITHOUT THE DEP PLAN. UPON REVIEW OF OPERATING MANUALS AND DISCUSSIONS WITH ACR SAFETY DEPTS, I NOW UNDERSTAND THAT INFO FROM THE DEP PLAN INVOLVING SECURITY AND OTHER CONCERNS IS REQUIRED FOR EVERY FLT. I UNDERSTAND THAT MY DECISION WAS IN VIOLATION OF FAR AND FLT MANUAL REQUIREMENTS. I SHOULD NOT HAVE LET THE NEED TO GET THE REMAINING PAX TO THEIR DEST OVERRIDE THE NEED TO COMPLY WITH REGS. I DID NOT REALIZE THE VIOLATION UNTIL I TALKED TO ACR SAFETY TODAY. I REGRET THAT THIS RPT IS REQUIRED AND THAT IT IS SUBMITTED AT THIS LATE DATE.
