Narrative:

WX at ase was reported as 4800 ft overcast 10 mi visibility, but tower reported on tower frequency it was better than 6500 ft overcast over the field. Approach control vectored us 7 NM north of the dbl VOR, gave us a base vector, followed by a 190 degree heading to join the dbl 164 degree radial approach course inbound, descend to 14000 ft, cleared for the VOR DME to aspen. My first officer declined the clearance, saying we are not authority/authorized to execute the approach (the VOR DME at ase is not applicable to CAT D aircraft, which is what our hawker 1000 is). The first officer stated we could continue to track the 164 degree radial off dbl at the MVA. The controller approved this and gave us descent clearance to 13000 ft. We saw the airport at 3 DME south of dbl VOR, configured for approach, call airport in sight, and was directed to contact tower. Ase tower cleared us to land, we turned a modified left base runway 15. We had a flap malfunction, and could not make the steep descent, so we executed a go around, called tower as we were establishing on the pkn 300 degree radial course outbound. Tower told us to proceed immediately to the missed approach point. We were already outbound, and could not safely comply. We were not fully set up for the VOR approach, since we are not authority/authorized to fly it. We can only accept a visual. Tower told us to contact approach. While initiating a call to approach, they told us 'traffic was at our 12 O'clock, same altitude (14000 ft) and less than 1 mi, climb to 16000 ft.' we were VMC, I saw no traffic but executed a maximum power emergency climb to 16000 ft. I did not hear approach talk to any other aircraft, and no mention of a conflict by approach.

WE HAD A FLAP MALFUNCTION, AND COULD NOT MAKE THE STEEP DSCNT, SO WE EXECUTED A GAR, CALLED TWR AS WE WERE ESTABLISHING ON THE PKN 300 DEG RADIAL COURSE OUTBOUND. TWR TOLD US TO PROCEED IMMEDIATELY TO THE MISSED APCH POINT. WE WERE ALREADY OUTBOUND, AND COULD NOT SAFELY COMPLY. WE WERE NOT FULLY SET UP FOR THE VOR APCH, SINCE WE ARE NOT AUTH TO FLY IT. WE CAN ONLY ACCEPT A VISUAL. TWR TOLD US TO CONTACT APCH. WHILE INITIATING A CALL TO APCH, THEY TOLD US 'TFC WAS AT OUR 12 O'CLOCK, SAME ALT (14000 FT) AND LESS THAN 1 MI, CLB TO 16000 FT.' WE WERE VMC, I SAW NO TFC BUT EXECUTED A MAX PWR EMER CLB TO 16000 FT. I DID NOT HEAR APCH TALK TO ANY OTHER ACFT, AND NO MENTION OF A CONFLICT BY APCH.
