Narrative:

As an EMS pilot I was dispatched to pick up possible patients from a pipeline explosion. After waiting approximately 3 hours it was determined that there were no serious injuries and that no patients would require transport. In preparation for departure, I filed a VFR flight plan with FSS. As we departed we proceeded past the accident site to determine exactly where it had occurred. After departing the area, I changed to ARTCC frequency and overheard that there was a tfr established for the accident location. The tfr was 5 NM radius up to 2000 ft AGL. Our flight path was within 5 NM and climbing from the surface to approximately 2000 ft prior to clearing the area. (The hospital pad was probably within that designated area.) when I contacted FSS (the controling FSS for that tfr) I did not specifically ask about a tfr, nor was that information volunteered.

Title: PLT OF AN EMS HELI FLEW THROUGH A TEMPORARY FLT RESTR AIRSPACE DURING DEP FROM A HOSPITAL PAD WHERE IT WAS STANDING BY FOR TRANSPORTING POSSIBLE INJURED VICTIMS FROM AN EXPLOSION SITE.

AFTER WAITING APPROX 3 HRS IT WAS DETERMINED THAT THERE WERE NO SERIOUS INJURIES AND THAT NO PATIENTS WOULD REQUIRE TRANSPORT. IN PREPARATION FOR DEP, I FILED A VFR FLT PLAN WITH FSS. AFTER DEPARTING THE AREA, I CHANGED TO ARTCC FREQ AND OVERHEARD THAT THERE WAS A TFR ESTABLISHED FOR THE ACCIDENT LOCATION. THE TFR WAS 5 NM RADIUS UP TO 2000 FT AGL. OUR FLT PATH WAS WITHIN 5 NM AND CLBING FROM THE SURFACE TO APPROX 2000 FT PRIOR TO CLRING THE AREA. (THE HOSPITAL PAD WAS PROBABLY WITHIN THAT DESIGNATED AREA.) WHEN I CONTACTED FSS (THE CTLING FSS FOR THAT TFR) I DID NOT SPECIFICALLY ASK ABOUT A TFR, NOR WAS THAT INFO VOLUNTEERED.
