Narrative:

Departed runway 8R at phx. Noise abatement instruction says no turns before 4 NM fix. ATC is giving direct sjn (st john) at about 2 - 2 1/2 mi. Since ATC direction takes precedence (possible conflict with other aircraft, etc) for safety reasons, a conflict is being created between the city of phoenix noise abatement requirement and the FAA clearance. We followed clearance from ATC, but that generated an inquiry from the city of phoenix noise abatement office. Suggest ATC and city of phoenix coordinate to eliminate this dangerous conflict. Supplemental information from acn 413904: on sep/xa/98 ATC cleared air carrier X to depart phx via the st johns 2 departure as cleared. After crossing pxr, air carrier X proceeded to approximately 3 mi east on the 075 degree radial, at which time phx departure cleared the flight directly to st johns VOR (sjn). An immediate turn was made toward the sjn VOR as filed. Phx departure procedures to the east specify an exit gate out to the pxr 4 DME point prior to turns for noise abatement. If this is a hard fast rule requiring mandatory compliance, the clearance should not have been issued to air carrier X to proceed directly to sjn until the 4 DME fix was reached.

Title: FLC CLAIM THAT THE DEP CTLRS AT PHX ARE ISSUING DEP HDGS TO ACFT THAT VIOLATE NOISE ABATEMENT PROCS FOR THE ARPT.
