Narrative:

The aircraft logbook had a deferred item (leaking hydraulic flight control actuator) that required a daily leak rate check and logbook signoff. I contacted maintenance control for my airline and asked if the check and signoff was required before the first flight of the day for the aircraft (which this flight was). I was told that it was not necessary to do it before the first flight of the day -- it was required to be done sometime during a day that the aircraft was flown and was scheduled to be accomplished after we had flown to lga and back. Prior to takeoff to lga, I checked the flight operations manual section that covers mechanical irregularities and MEL policy and found that MEL items that require a daily check are to be checked prior to the first flight of the day. I then contacted maintenance control on the radio to point this out, and was told that the leak check did not fall under the MEL policy but rather the boeing maintenance manual which only specified a check be accomplished once a day.

Title: A B757-200 WITH A DEFERRED HYD LEAK THAT THE DAILY LEAK CHK TIMES REQUIRED BY THE MEL CONFLICTED WITH THE MANUAL.

Narrative: THE ACFT LOGBOOK HAD A DEFERRED ITEM (LEAKING HYD FLT CTL ACTUATOR) THAT REQUIRED A DAILY LEAK RATE CHK AND LOGBOOK SIGNOFF. I CONTACTED MAINT CTL FOR MY AIRLINE AND ASKED IF THE CHK AND SIGNOFF WAS REQUIRED BEFORE THE FIRST FLT OF THE DAY FOR THE ACFT (WHICH THIS FLT WAS). I WAS TOLD THAT IT WAS NOT NECESSARY TO DO IT BEFORE THE FIRST FLT OF THE DAY -- IT WAS REQUIRED TO BE DONE SOMETIME DURING A DAY THAT THE ACFT WAS FLOWN AND WAS SCHEDULED TO BE ACCOMPLISHED AFTER WE HAD FLOWN TO LGA AND BACK. PRIOR TO TKOF TO LGA, I CHKED THE FLT OPS MANUAL SECTION THAT COVERS MECHANICAL IRREGULARITIES AND MEL POLICY AND FOUND THAT MEL ITEMS THAT REQUIRE A DAILY CHK ARE TO BE CHKED PRIOR TO THE FIRST FLT OF THE DAY. I THEN CONTACTED MAINT CTL ON THE RADIO TO POINT THIS OUT, AND WAS TOLD THAT THE LEAK CHK DID NOT FALL UNDER THE MEL POLICY BUT RATHER THE BOEING MAINT MANUAL WHICH ONLY SPECIFIED A CHK BE ACCOMPLISHED ONCE A DAY.
