Narrative:

Ewr was running 2 runway operation. Departing runway 4R landing runway 29 (ILS runway 4R circle at marker, land runway 29). We were issued landing clearance runway 29 at the runway 4R marker. We circled to runway 29 and upon reaching short final, noticed a B727 rolling runway 4R. I, PNF, queried local controller and he said that we were still cleared to land runway 29. At this point, the B727 was airborne and the only safe action was for us to continue, pass beneath the flight path of the departing B727 and land. Had we tried to go around, there would have been a traffic conflict. This is normal procedure at ewr. We should have accepted the landing clearance subject to there being no departing traffic on intersecting runway.

Title: FLC OF AN EMBRAER REGIONAL JET E145 LANDED UNDERNEATH A DEPARTING B727 ON AN INTERSECTING RWY. THE RPTR DISCOVERED THE DEPARTING B727 WHILE ON SHORT FINAL AND QUESTIONED THE CTLR IF THEY WERE STILL CLRED TO LAND, TO WHICH THE CTLR REPLIED THAT THEY WERE.

Narrative: EWR WAS RUNNING 2 RWY OP. DEPARTING RWY 4R LNDG RWY 29 (ILS RWY 4R CIRCLE AT MARKER, LAND RWY 29). WE WERE ISSUED LNDG CLRNC RWY 29 AT THE RWY 4R MARKER. WE CIRCLED TO RWY 29 AND UPON REACHING SHORT FINAL, NOTICED A B727 ROLLING RWY 4R. I, PNF, QUERIED LCL CTLR AND HE SAID THAT WE WERE STILL CLRED TO LAND RWY 29. AT THIS POINT, THE B727 WAS AIRBORNE AND THE ONLY SAFE ACTION WAS FOR US TO CONTINUE, PASS BENEATH THE FLT PATH OF THE DEPARTING B727 AND LAND. HAD WE TRIED TO GAR, THERE WOULD HAVE BEEN A TFC CONFLICT. THIS IS NORMAL PROC AT EWR. WE SHOULD HAVE ACCEPTED THE LNDG CLRNC SUBJECT TO THERE BEING NO DEPARTING TFC ON INTERSECTING RWY.
