Narrative:

Z time: XX50. Frequency/altitude: 135.9/FL190. ATC facility: ZNY. Location: 30 NM south jfk. 10 mins after takeoff passenger became unconscious, doctor attending passenger suggest return jfk. Returned 1 passenger deplaned. Departed again and misunderstood from first officer that we had new close-out but in fact departed with close-out from first flight. Numbers well within limits but 1 less passenger. Supplemental information from acn 397620: we returned to jfk to deplane an unconscious passenger. On our 2ND departure the captain thought we had a new close-out when in fact I had said I thought we were all right with the original close-out since it was exactly the same conditions with very minor differences (1 less passenger, slightly more fuel). I felt comfortable since all the data was for the same aircraft, same station and same conditions. Captain felt we should have received a new close-out since it was for a different departure.

AS FLC DEPARTS JFK A SECOND TIME, THE FLC DOES NOT RECHK THE FINAL TKOF WT FIGURES, THEIR RATIONALE IS THE WT CHANGE IS MINIMAL AND WT WAS TAKEN OFF, NOT ADDED, WHICH MEANS PERFORMANCE FOR TKOF WOULD NOT CHANGE.

I FELT COMFORTABLE SINCE ALL THE DATA WAS FOR THE SAME ACFT, SAME STATION AND SAME CONDITIONS. CAPT FELT WE SHOULD HAVE RECEIVED A NEW CLOSE-OUT SINCE IT WAS FOR A DIFFERENT DEP.
