Narrative:

Approaching bossie intersection inbound during IMC approach received RA to climb. Targets on TCASII merged. Passenger reported aircraft passed underneath us. After climb, completed another approach to landing. WX was 100 overcast and 1 mi visibility. Callback conversation with reporter revealed the following information: both aircraft were at 5000 ft in IMC conditions. Reporter called the facility and was told it was an operational error with quoted separation of 100 ft and 1.7 mi separation. Reporter reiterated that the passenger saw the aircraft pass under their aircraft during the climb. They were on the tower frequency and after climbing received instructions by the local controller to turn immediately to the right reference the traffic which by then they had climbed to 5500 ft and had broken out of the clouds.

Narrative: APCHING BOSSIE INTXN INBOUND DURING IMC APCH RECEIVED RA TO CLB. TARGETS ON TCASII MERGED. PAX RPTED ACFT PASSED UNDERNEATH US. AFTER CLB, COMPLETED ANOTHER APCH TO LNDG. WX WAS 100 OVCST AND 1 MI VISIBILITY. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: BOTH ACFT WERE AT 5000 FT IN IMC CONDITIONS. RPTR CALLED THE FACILITY AND WAS TOLD IT WAS AN OPERROR WITH QUOTED SEPARATION OF 100 FT AND 1.7 MI SEPARATION. RPTR REITERATED THAT THE PAX SAW THE ACFT PASS UNDER THEIR ACFT DURING THE CLB. THEY WERE ON THE TWR FREQ AND AFTER CLBING RECEIVED INSTRUCTIONS BY THE LCL CTLR TO TURN IMMEDIATELY TO THE R REF THE TFC WHICH BY THEN THEY HAD CLBED TO 5500 FT AND HAD BROKEN OUT OF THE CLOUDS.
