Narrative:

On loupe 9 departure we were climbing southeast of sjc VOR on vectors from bay approach. We were cleared back direct to the sjc VOR to resume the loupe 9 departure. We were given a clearance to cross sjc at 12000 ft. We heard cross sjc at or above 12000 ft, maintain FL230, and given a frequency change. We crossed sjc above 12000 ft. When we checked in on the next frequency leaving 14500 on our way to FL230, the new controller informed us the clearance was to cross sjc VOR at 12000 ft and maintain 12000 ft.

Title: FLC OF AN MLG FAILED TO CROSS AND MAINTAIN 12000 FT OVER THE SJC VOR DURING THE SJC LOOP DEP SID DUE TO A MISUNDERSTANDING OF A SUBSEQUENT CLRNC TO A HIGHER ALT. THEY DID NOT UNDERSTAND THAT THE SID XING RESTRS WERE NOT REMOVED.

WE HEARD CROSS SJC AT OR ABOVE 12000 FT, MAINTAIN FL230, AND GIVEN A FREQ CHANGE. WE CROSSED SJC ABOVE 12000 FT. WHEN WE CHKED IN ON THE NEXT FREQ LEAVING 14500 ON OUR WAY TO FL230, THE NEW CTLR INFORMED US THE CLRNC WAS TO CROSS SJC VOR AT 12000 FT AND MAINTAIN 12000 FT.
