Narrative:

After departing nellis AFB on IFR flight plan to vny, my push to talk switch was inoperative. I could not transmit to controller, 'back seat' could transmit. Back seat crew, while a pilot, was not familiar with IFR procedures. Between the stress of the situation and my attempts at explaining to him what to relate to controller a miscom occurred. I realized that it would be easier to fly VFR and asked the back seat pilot to cancel our flight plan and we would proceed VFR. I was under the impression we were VFR with flight following. The controller interpreted his communication with the back seat pilot to mean we were VFR on top on an IFR flight plan. We flew off of the IFR course by several mi. The controller advised us of our position. We then formally canceled IFR and proceeded VFR without incident.

Title: T33 OFF LSV-VNY WAS UNABLE TO COMMUNICATE FROM FRONT COCKPIT ACCOUNT PUSH TO TALK SWITCH INOP. BACK SEAT OBSERVER COULD COMMUNICATE. PLT RATED BUT NOT IFR QUALIFIED. PLT SAID TO CANCEL IFR AND CTLR THOUGHT THEY WERE RPTING VFR ON TOP. LATER WHEN DEVIATING FROM FLT PLAN THE IFR CLRNC WAS AGAIN CANCELED.

Narrative: AFTER DEPARTING NELLIS AFB ON IFR FLT PLAN TO VNY, MY PUSH TO TALK SWITCH WAS INOP. I COULD NOT XMIT TO CTLR, 'BACK SEAT' COULD XMIT. BACK SEAT CREW, WHILE A PLT, WAS NOT FAMILIAR WITH IFR PROCS. BTWN THE STRESS OF THE SIT AND MY ATTEMPTS AT EXPLAINING TO HIM WHAT TO RELATE TO CTLR A MISCOM OCCURRED. I REALIZED THAT IT WOULD BE EASIER TO FLY VFR AND ASKED THE BACK SEAT PLT TO CANCEL OUR FLT PLAN AND WE WOULD PROCEED VFR. I WAS UNDER THE IMPRESSION WE WERE VFR WITH FLT FOLLOWING. THE CTLR INTERPRETED HIS COM WITH THE BACK SEAT PLT TO MEAN WE WERE VFR ON TOP ON AN IFR FLT PLAN. WE FLEW OFF OF THE IFR COURSE BY SEVERAL MI. THE CTLR ADVISED US OF OUR POS. WE THEN FORMALLY CANCELED IFR AND PROCEEDED VFR WITHOUT INCIDENT.
